Head on the block..

Today my employer announced redundancies. Most things were done by the book as far is i could tell. The pools etc were given and on thursday we find out who is provisionally given notice. I do have some concerns regarding the selection procedure though.

If on thursday i find out i am am one of the unlucky ones is it worth mentioning that i believe CIPD guidance has been breached or am i better off waiting till any potential appeal ?

I am not looking to make trouble and if i believed i was the " best " candidate for redundancy i would accept that gracefully.

Any comments gratefully received.

    You can mention anything you want but it won't change the fact. CIPD guidance is just that, guidance.

    Yes i know that but breach of it would indicate wrong doing as CIPD guidance and codes of practice are considered industry standard.

    Hopefully i will not even have to bring it up !

    Doesn't matter. They're still only guidance to be taken or ignored as is seen fit. You can bleat on about it all you want but until employment laws have been broken, that's all you can do.

    Fair enough and i understand what you are saying. But you have to in some way prove that employment law has been broken. I would have thought CIPD documents can at least be offered as evidence of this .

    CIPD advocate "best practice" which is often more than what is demanded by law. Employers only have to abide by the law, not CIPD guidelines.

    If your company redundancy policy breaches the law, you have a case. If within the law, but against CIPD guidelines, you have no case.
