Hi
I would be really grateful for some advice
I'll keep the background brief
about summer time I agreed on the phone to sign up with talktalk for phone and broadband
then I changed my mind within the cooling off period and sent an email and phoned and wrote a letter - all which I kept copies of - saying I changed my mind and I cancelled
then they put my account through anyway and disconnected me from bt
they sent a letter to me which I still have confirming they made an error, and apologising
then they are now trying to get me to pay about £125 as a cancellation fee!
Shall I call talktalk one more time and settle with them? They are time wasters as they told me in the past the matter was closed then told me another thing then another
they did offer if I paid for the calls only – about £25, the matter would be settled, but what proof do I have then won't then later register a default?!
I am worried because I am planning to remortgage and move house next year and my credit file is clean
also I work for a bank and I can get into trouble at work as they regularly credit check us
I have a free legal helpline through my home insurance – they said they will send me a claim pack but I don't know in truth if that will help me, whether I can claim any compensation for the stress of all of this, my wife is also about to give birth. The policy covers me for a maximum of 50000 but I am doubtful if the service will really help, it is just a freebie with my home insurance and on the phone they were very reluctant to get involved.
please give me some advice!
THANKS

CSL – the dca, agreed that I owe nothing as I faxed them a copy of the letter talktalk sent me but they keep on allowing talktalk to register the collection, it just gets bounced back to them after a month or so every time

Don't bother phoning them.
Write to talktalk and request a copy of their official complaints procedure. Follow this and enclose a copy of the letter stating that they had made a mistake - they should not be chasing a debt if there is nothing owed. If you pay, you may be accepting liability for the debt so i would go down the complaints procedure first. If nothing comes of this then you can show the regulator that you have tried to resolve the matter and you can ask them to sort it out.
Make sure you send the letters by recorded delivery so you have proof that the letters are received. They woun't be able to claim it was lost in the post that way. After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91
Dad Gift 6k ¦ Savings & Inv Tst: £2,500
Loan 10k: £0 ¦ Dad 5.5k: £2,270 ¦ LTSB: £0 ¦ RBS: £0 ¦ Virgin £0 ¦ Egg £0
Total Owed: £2,270 (+6k) 11/08/20110 -
thanks for this advice
