MBNA - Any experience

MBNA cannot provide me with a signed copy of a CCA and have said that they don't need to, instead sending me their complaints procedure document. The letter itself was from the ' vice president' so whats the point of complaining further.

Shall I just let them get on with things and see what happens.

Any help would be really appreciated.

Im going to take a rough guess at the initials of this person - RC, (could be wrong)

This is complete twaddle - you are still entiitled to your credit agreement - was this originally a MBNA card, or is it one they have bought (Abbey, A&L, or HBOS - I'll put money on this latter one)

The usual speal is "the combined effects of the consumer credit act...."

There are better experts than me on the CCA subject (im just an expert on MBNA as I work there:rotfl: )

I think if you were to forward this to the relevant people (OFT or FOS maybe) then they could help.

There isnt much point in going through their complaints procedure unless you need a final response (ie for FOS) as the complaint will bedealt with by the same office.
No Longer works for MBNA as of August 2010 - redundancy money will be nice though.

If you have made a request for the Original Agreement along with the standard fee of £1 thy HAVE to produce it within 14 days, if they dont then the debt is 'in dispute' and they cannot enforce collection, add interest or charges UNTIL an agreement is produce. This is the Law.
Take a look at National Debtline Site, or search this forum.
A past record of payments being made to the Account is NOT proof that there is an Agreement in place.

Thankyou everyone, yes Oscar you are correct and the card was originally Abbey National, there doesn't seem much point writing to any ombudsman, if they can't produce it a letter elsewhere isn't going to change that. I might just see what happen. I am sending a token £5 per month to them anyway.
