if you continue to consider saying yes, spell out that one reason why you left was because of their family unfriendly policies, and you would like assurances that these have changed! The law has changed since you left, which is a good starting point.

As your husband works for himself, and particularly as his work is quiet at the moment, is that really such a problem? Is he worried that he may have to pick up the reins if the children are ill - if so, that seems pretty selfish to me.

Take the job, his work is drying up and do you really want to start dipping into savings?

I'd tell them if I were to come back I would want more than minimum wage. See what they say.
