consultation period.... Advice..

Dear All....

After working for my company as a Sales Manager for over 2.5yrs, being promoted in this time, not oly hitting but smashing targets I was told monday that they were going to make a realignment of teams and 3 managers jobs would become 2. And that my interview was going to be friday.

I had my interview and was told I was unsuccesfull and was on consultation.

I have been asked to go in on monday as normal, and I believe they want me to help i the transitional period whilst the teams merge.

I think it's a cruel and unusualpunishment for them to expect me to assist in somone else run my team knowing I'm out of a job at the end of it.

Where do I stand if I refuse? Also can I raise a grievence against the selection procedure and if I did what would this achieve?

    You can raise a grievance against the selection procedure if you believe it was unfair. If your grievance was upheld the company would need to sort out with you what was the best way forward.

    As far as assisting the teams merging, I'm afraid that you are being paid to do a job, no matter how personally unpalatable it is. They may or may not bother taking you to disciplinary if you refuse to do it - but remember that gross misconduct, such as refusing to obey a reasonable management instruction, could lead to dismissal without notice, and that potentially you could lose your redundancy money that way.

    ok - so if I didn't refuse as such - but did nothing to help, or was really bad at it, would I be OK then?

    Obviously wouldn't want to jepordise a redundancy package - but REALLY don't want to help them - would rather go on garden leave

    I'm on a 3 month notice period, so in an ideal worldwould be paid off to go quietly.

    Any suggestions?

    I would focus on the individuals inyour team who are going to be a bit scared and worried at the monet, and focus on that, not your own needs. Tough, yes, but a better headspace to be in.

    Do it for the reference...just agree beforehand that the reference will be excellent.

    They often let the good ones go because there's more chance of them getting jobs elsewhere quicker - what's the agreement on you spending time looking for another job - you might be more successful quicker than you thought and you obviously have to put energy into that side of things now.

    Well it's all imaterial now....

    I discussed with HR my feelings about hellping the new manager ad said if I'm not good enough to run the team why do you needmy help? Surely the 'stronger' candiate would be fine without me????

    And now I'm on Garden leave, HR said they were niaeve to think that it would be an option and to ask me to come in everyday is unreasonable.

    So all the time in the world to look for a new job!
