Robinson Way DCA and possible 5 year old JD Williams debt?

Last night my mother had a phone call from Robinson Way DCA saying she owed over £1000 to JD Williams, but that they would reduce it to £815 if she paid the amount within 3 months, they also asked for a payment over the phone which she did not give as she didnt know what they were talking about.

She did have a few debts problems years back and on looking back at an old Equifax report from 2003 with various debts on it the JD Williams account was there with a similar figure to what Robinson Way had stated, £100 more infact.

my mother had at the time been to the CA and made arrangements with her debtors and on this report my mother had written the figures and when each account would be payed off. "Will be payed off march 2004", "dec 2004" etc

All of the debt, with the exception of one which she is still paying, has been paid off and she has letters from another DCA stating this, next to the JD Williams one she had written "will be payed off May 2005"

Unfortunately she cant, as yet, find any record of the payments for this one, or which DCA it went through although Wescot rings a bell, but it seems a bit unlikely that this wouldnt have been paid like the others and if indeed it hadnt been paid why has she never in the last 5 and a half years had a letter, threatening or otherwise, about it?

Anyone have any ideas as to why this has suddenly came out of the blue?

    several options, none of which are pay immediately.

    1. Do nothing and certaily do not pay.
    2. Request the CCA, but make sure she puts "I do not acknowledge and Debt to your company" at the top of the letter. Certainly do this before makingany payment.
    3. Get her credit records and see if anything show up there.

    I would be tempted to find out the exact date of her last payment to the JD Williams account as debts are statued barred after 5 years in Scotland and I notice you are resident here.

  • Just an update to this...
    On saturday morning my mother got the threatening court letter in from Robinson way.

    She had a look and last night she found the receipts for this debt, which appears to have been paid in full, the last receipt is for a balance of £24 which was paid on 1/03/04 to a company called Express Debt Collection, who incidently are part of the Robinson Way group!!

    What are these guys playing at, are they just chancing their arm and trying to get my mother to repay the same debt or is it just a clerical error maybe??

    just glad she didnt start paying them anything!

    Any ideas why they are trying to reclaim this debt 4 and a half years after it was paid in full??

    Here's a bump.

    I think the DCA may be trying to pinn someone with a similar name to your mothers debt onto your mother.

    The national debtline website has a letter you can send them.

  • no it has the same amount owed and account number as the original letter back in 2003 just a different reference number.

    we phoned them this morning and they were trying to fob my mother off so i took over the call and explained that we had all the receipts from Express DC detailing balances and amounts paid and the final letter saying the account had been paid in full in march 2004.

    he asked for a copy of the receipts from this "other" agency but i pointed out that Express was a trading name of Robinson way so they should already have them all.

    i gave the guy the reference number of the old account and he said it wasnt valid, i told him he should look into it as there was no way my mother was paying anything to an account she'd cleared 4 and a half years previously.

    i also asked why, if it was still outstanding, she hadnt had any letters from themselves or JD Williams demanding payment in the intervening years?

    During this he kept putting me on hold, probably speaking to a manager or something, then eventually said that the account would be put on hold while they contacted JD Williams and they would try and get it sorted out.

    i asked that when they did my mother would be sent another letter stating that the account was indeed paid in full.

    Anything else i should do?
  • No expert in this field but it appears your mum has evidence to say its been paid. Suggest the standard letter - not acknowledging the debt and a copy of the debt paid letter sent by registered post.

    Probably a copy of the recent letter sent and highlight the account numbers on both copies.

    Don't sign the letter - print your name.

    Don't pay anything. Don't speak to them on the phone, say you will only correspond in writing.

  • On Wedensdayday my mother received another demand for payment letter and payment slips which i told her to ignore.....on Friday she received a letter saying the account is now closed, that'll be that then!
