HELP with HSBC

Hi, guys,

Not sure if this is the right place to post this but i need help.

To cut along story short, my girlfriend lost her job 2 years ago, as her company went bust, so she last a whole months wages. We went £1900 overdrawn with HSBC, things got worse and 2 other account went overdrawn as we tried to make ends meet.

In the end HSBC were charging £150 fees on each account but still paying the DD's. We just let them as the bills were being payed. We ended up best part of £5000 overdrawn in total on all 3 accounts.

We decided to move our wages into another bank, so we could try and sort it. We paid off £3000, which we got from Family help, then have been paying £30 into each account, each month.

Today i got a final demand letter, for one of the accounts, we have tried to talk to them and have been messed around, like the said they would call us and never did.

This amount is £890 but we own £1900 in total, i spoke to them tonight and gave in all our outgoings, and even thought i paid them a total of £90 each month for the 3 accounts, they say they can not help, and all we can do is do an IVA.

We are just keeping our heads above water, and not gone behind on another bills, such as mortgage etc but really struggling to afford to buy food, but to us the bills are the most important thing.

They say that if i dont sort it with 7 days, they will take us to court, over £1900 and get the debt collectors in.

We dont want to do an IVA, can they make us over £1900? and do you think they will take us to court, even though we are paying money into the accounts and not using them?

Any help would be great as they have done a great job of scaring us.

    sorry mark and jo i cant offer any advice ...but i know there are plenty on here that will be able to so dont give up hope ...they are maybe working or busy just now ...but will get to you ...if it slips off the front page just keep bumping back on to it ...someone will come...you can also try the ask cccs any question bit at the top theose guys are usually on the ball as well

    Im sorry to hear about your predicament...

    Out of interest, how long did it take your gf to find another job?

    The bank must have sent you letters during this time and tried to contact you by phone?

    Not all bills are the most important thing. Mortgage is definitely, along with a few others but food before credit cards!

    Be firm with them ,but only communicate my letter .Do not talk on phone to them , you need a paper trail . You must also only pay what you can afford no more . Never pay a unsecured debt rather than a utility bill . They will huff and puff but IF it was ever taken to court a JUDGE will see you are trying hard to deal with your debts and will be on your side . You should never give debit card details , it has been known for these companies to withdraw more than agreed amounts. Are any of your card debit with a company connected to your bank , if so open new account . They are entitled to take money from an associated account . Above all do not worry it costs them alot of money to go to court.
  • Thanks guys, we are paying the important stuff like mortgage etc, my girlfriend was out of work for just over 1 month, but that meant nearly 2 months of wages as she didnt get what she was owed from her company. We are just speaking to CCCS now, but only got the letter today, giving us 7 days to pay, when we went overdrawn at first they just sent as letters saying that an informal overdraft as been agreed, and that was it, for over a year they never once stopped a DD, just kept adding on £150 charges on each account. All the money we owe them really is for charges, as i worked out over the last 3 years they have put at total of £3300 in charges, and we paid in £3000 to clear some off it. I have tried claiming them back but no luck.

    You can't do an IVA as you have to owe £15k for one. I think the bank are just trying to scare you.

    You could try reclaiming your charges as a hardship case.
    Unless I say otherwise 'you' means the general you not you specifically.
