"Final Absense Review"

Work are asking me to go in for one of these.i'm currently signed off until the 20th of december by a surgeon i underwent maxilo facial surgery. now they are asking me to go in or for them to come to me to discuss my absense and previous non-related absenses they so review previous action plans etc. but i don't feel upto i'm supposded to be resting. i've told them i won't be attendending any meeting and that they won't be coming around to my house as i don't feel upto due to having major surgery. the letter says they can dismiss me on the grounds of "incapacity".

so i'm not attending what can they do? are they allowed to pursue this line of reviewing previous, unrelated absenses? they are going to have the meeting in my asbsense - what's likely to happen?

    You getting sacked is what is most likely to happen. If you're not prepared to compromise why should they? You aren't doing yourself any favours with that attitude.

    I have to agree that this is an option. The purpose of the meeting is to find the best way forward for you and the employer, and your unwillingness to co operate implies that you do not wish to aid your return to work.

    Have you had any meetings/ disciplinary action regarding previous absences?

    Did you decide to be honest with your employer about your pre existing condition as noted in previous posts?

  • i've just undergone major surgery ...and they want me to discuss/review previous non-related absences? i can hardly speak !!!!!!! i do have the option of sending in a union rep in my absesne? will that help my cause?

    i've never had any official disaplianry prcedure for previous absense...only a quiet word with the boss ... my 6 month probabition period ends next week (they've arranged the meeting for the day after lol)

    surely they cannot get rid of me for not being well enough to undergo their verbal drilling i've been off due to stress previously but this is non-related and they know that via sick notes from my surgeon the sick notes goes until the 20th of decemeber when the recouperation period ends ..i've already inform then i plan to go back on this date.

    dmg24 - they don't have access to my medical records i did fill out the form and send it back but last week they requested i fill out the same form so i assume they haven't got it. also it's a perm unconditional contract

    My feeling is that the meeting has been timed to say that they will not be making your position permanent. I could be wrong, but it seems a big coincidence.

    Why do you feel that you are going to get a verbal drilling? How much time have you had off, and how much time have you been with the company?

    You have changed your above post, and you now state that you are coming to the end of your probationary period, however you are on a permanent unconditional contract. It can't be both?

    You also do not state if you completed the previous form honestly, which your previous posts implied that you did not intend to?

    It sounds like you will be sacked.

    Even if the absences are unrelated and signed off they can still sack you, as you are incapable of doing the job they have employed and paid you to do.

    And since your 6 months in probationary, seems more likely.

    Dust off the Cv and start fresh.

    Expect your P45 in the post. You're on a probationary period and you have basically told them to go stuff themselves.

    They don't need a reason to sack you in the first 12 months employment.

    Yes if you have a union rep that is who you need to be talking to. Ask them if they will go to the meeting and ask them what if any rights you have.

    Also if you are unable to or it is uncomfortable/painful to speak due to the facial surgery tell them this is the reason and not because you are unwilling, try requesting the meeting be postponed. They will quite likely refuse to postpone but at least it will be noted why you could not attend.
