Help,Full and Final

Hi Guy's.
Have negotiated a F and F with Blair Oliver Scott wrote in the standard template letter you know " I offer £X in full and final settlement of my account if agreeable please offer assurance that you nor 3rd party will pursue you mark my credit file as settled etc etc etc"
Anyway no response after 10 Days so i call them and they agree to £x over the phone i request confirmation in writing as per my initial letter.
Today we get a one lined letter from them which reads

A partial settlement has been offered on the above account for £X to be paid no later than 00/00/08.

Hardly what i was after and does not appear to be much protection there for me if i pay £x. Appears nothing there to stop them continuing with the matter.

I have no issue with my credit file being marked "Partial" settlement the word partial in that context is fine by me but its so ambigous do they mean "yes we'll take your offer and then as it's Partial ask you for the balance later???"

    They are trying to pull a fast one.

    Write back referring to your original letter stating that you intend making a F&F offer of £x, not a partial settlement as stated in their letter of xx/xx/xxxx. If this is acceptable, please confirm in writing their agreement to accept £x as a full and final offer.

    Add to that the extra stuff from the national debtline letter that other companies won't try to seek payment for the debt.

    The way they have written the letter above, they are saying yes, we agree to a partial settlement and we'll contact you next month for the rest of it. DON'T PAY.

  • Cheers George that's how i see it as well. I'll call em when the MRS gets in as it's her account and they won't discuss it with me although they were happy to speak with me 10 days ago when offering to F and F the account:rolleyes:
    I'll tell em send me the correct response you know won't pursue etc etc and i'll pay it ( Well once MIL has given us the dosh)
  • Just called em. Not bad to be fair. Explained myself and basically dictated what i wanted them to say they typed it there and then and are sending out the letter stating credit file marked "Partial" settlement but they nor 3rd party will pursue the balance and our account will be closed.
    Sound alright? I thought so but open to any observations.

    This is the nationaldebtline letter:
    Dear Sir/Madam

    Re: 4563210025897412

    We write with reference to the money which you are claming on the above account.

    We can confirm that we are unable to offer to pay the money which we owe in full. However, I can raise £775 and I want to offer this an ex-gratia payment in full and final settlement of the account. This offer is made on the clear understanding that, if accepted, neither you nor any associate
    company will take any other action to enforce or pursue this debt in any way whatsoever and that we will be released for any liability.

    We also request that, if accepted, you will make an entry on a credit reference agency file relating to the above account as "satisfied" in full.

    Payment can be made within 2 weeks of receiving your written agreement of this offer and method of payment.

    We look forward to receiving your reply.
