Help - Where does he stand??

Hi everyone!

I'm after a bit of advice on behalf of my partner.

He started a new job in October as a trainee sales manager, he had just been laid off as a trainee kitchen fitter due to the credit crunch and managed to find this job quite quickly.

Unfortunatley, due to stress etc he had a breakdown (which he has previously had) and unfortunatley, in his case he tends to go down very quickly. So he had worked a full week and went in on the monday, i called him in sick on the tuesday and by wednesday he was in hospital. I spoke to his manager and advised that he would not be coming back due to personal reason etc. I did ask the manager at the time, if he would get pay for the week he did, and he just said that it will be put through HR.

We have not heard anything from them, and Friday is payday. If he does not recieve any pay for that week, where does he stand?? Is he entitled to that week, or becuase he just left without notice is he not??

    Has he left or is he off sick? If off sick he needs a doctor's note for more than three days' sickness. He should be paid for the week that he did though. Why don;t you wait and see on Friday?

  • Yeah, that's our plan - to wait and see if anything is paid to him on friday.

    As for the job, we felt it was too stressfull for him and this is what brought on the breakdwon along with loosing his previous job etc. He has actualy left the job and is off their books now.

    This is what i was wondering, because he left without giving notice, is he entitled to the pay for that week he worked??

  • No, he was never given a contract which was an issue he was going to take up with them the week he fell ill.

    The last thing that someone like him should be applying for is a job with any managerial duties whatsoever as he is clearly incapable of coping with the demands of it because of his stress issues.

    Maybe in a few years if he's not had any episodes but honestly, do you think it's appropriate at the current time?

    No i dont think it is appropriate and that's why i called in and told them that he would not be returning to the post.

    It wasn't until it was too late, that we realised that this type of position was no good for him. The worry of loosing his previous job, and the worry of not having a job and a mortgage to pay kicked it off, but when he started the trainee manager job, that just topped it all off and he ended up having a relapse.

    He has had no problems at all over the past 6-7 years and due to other issues we all thought that it was over and wouldn't happen again. But, this time we have been given a diagnosis which is a good thing, and hopefully in the future he will be able to get a more peaceful job with no or little stress involved.

    But, we just want to know if he is entitled to the weeks wage that he worked before he left.

    Just to let you know that my OH received a paylsip this morning for that week he worked and his pay was paid into the bank today!! Phew, that is a major relief just before christmas!!!

    Sorry that i posted such a daft question, but my head is all over the place since he has been ill and all the worry - it's a nightmare!!

    Poor soul, you and your OH have my sympathy.

    Avoid sales jobs of any kind, they are tremendously stressful.
