Head 2 Head with Nationwide and i won

Just thought that i would let other people know you can win against the big guys.
Had a court hearing on monday for a redetermination hearing after prievious Northampton county court award to nationwide for me to pay back £10,000 in one year. ( absolutly now way, ccs advise to apply for a reditermination best bit of advice so far) After having a chat with the high power dressed lady solicitor for nationwide very cautious on answers to her but proved to be right move. 1st question asked by judge was had we had a chat outside, i think its just to confirm what we are both looking for. I was looking for the court to change the award to the £38.15 per month i had been paying on the cccs dept plan, nationwide was looking to obtain a charging order on the house to change the unsecured loan to a loan secured on the house. Judge after seeing that i have taken responsibility for my debt and set up the debt managment plan with the CCCS and also that nationwide had been accepting the payments upto the date of hearing with non sent back that she saw this as acceptance of the amount. Also checked that if my circumstances changed for the better i would pay more back. Then granted award for £38.15 payment to nationwide only per month and refused their request for a charging order despite the solicitors best efforts for 5 mins.
Great news nice to know that if you are taking responsibility for your debt then the courts will look favorably on your circumstances and prefer to grant the award to you and not the big bad banking organisation.
Using the CCCs was the best move i made with regards to managing my debt.

Excellent news Paul, really pleased for you, and agree entirely - courts do appear to look more favourably on those making a conscious effort to get themselves in order.
The trick now is to keep on top of it.....

Fab news! great to see a sensible judge, after all that's what most people are trying to do on this site, pay back their debt and if creditors had come to an arrangement then can't see why they have to take the court route of trying to obtain CO on unsecure debt. POWER TO THE PEOPLE!
