I would suggest that you put this into complaints asap so that they don't start adding arrears to your account and then start enforcement actions against you. i would include in the complaint how you had been given this information only to find that no such request for info was made.0

we got a letter out of the blue saying they want £28 quid a week, we are on benefits, =£94 a week.
we called them to ask what about and letter states we are working and get £222.79 a week exactly, they said they got info from inland revenue, we called them inland revenue no request made, csa advisor not available (surprise). csa lying, we called csa they said an application would go ahead 4 jail. oh my god, what are they stooping to. i want human rights act section against this.0 -

Provide them evidence of your benefits, it's obviously just a mix up.:j Baby boy Number 2, arrived 12th April 2009!:j0 -

First, calm down. There is no need for human rights act etc . If you are on JSA as you say then obviously a mistake has been made. There is no application for jail whoever told you that was lying. Start from the beginning and explain your circumstances.0 -
first off, are you supposed to be paying anything for a child/children anyway??
either way, i doubt they can take that off you when youa re on benefits. send them photocopies (not originals) of your benefits letters and make sure you send them by recorded delivery. and do this urgently, asking why they think you earn that much. dont talk to them on phone!!!! everything both ways MUST be in writing. and always, always, by recorded delivery. that way they have to sign for it and cant say that they havent had it. if they phone you, tell them you want everything in writing before you will respond.
get onto inland revenue again to see why they could have got anything like that information on you. did you earn that much in the last financial year???
send them photo copies of everything you have to prove your income, housing benefit letters etc. etc., then, before you wait for a reply, get to the CAB urgently. they can help you with everything.
and keep a copy of everything you send to them. there is obviously a problem here on their part, a big mix up and may even have the wrong person.
keep calm you wont go to jail. they dont do that over here and who ever said that to you is a dingbat.
good luck.xxxx0 -
The inland revenue can't confirm if the CSA have made an inquiry. Where do you think the CSA have got the figures from? ARe they out of date figures? If you are on JSA then the most they can take is £5 per week direct from your benefits. If you owe money then they will first have to get a liability order and then decide how to proceed. If you are paying and can prove that you are trying to pay back the money at an affordable rate, the CSA won't succeed in any committal application as they have to prove wilful and culpable neglect to pay. How much do you owe and how come it is in arrears?0

dont know for sure but i believe they can take any excess of what you need to live on which i think is the rates of income support but i dont think that amounts to £28 but could be wrong someone will be along with a more comprehensive answer soon i'm sure
