FOS have sent me a complaint form for Marbles Credit CArd

I have recieved a form from FOS with regards to my ongoing CCA request/complaint with MArbles.

FOS have prefilled some data - my name address etc.

They have also filled in the "..your complaint is about" with

Complainant is unhappy that his credit card provider will not issue a copy of the original credit agreement & have only provided a copy of the application form but this does not include the terms.

Is there anything else I need to put here - rest of the form seems pretty self explanitory. (though i am tempted to put in the box "what can the business your complaining about do to put things right" wipe out my debt, but i dont think it would go down too well:rotfl:

Any advice from experts that may have been here before?

    Since the date when you requested the CCA have marbles made any attempt to pursue the debt?

    If so you need to list each and every attempt to get you to pay a disputed debt.

    They have, but i cant remember all of the calls - all were to my mobile, so im assuming i'll have most on there.

    I havnt actually disputed the debt - i do owe it, i just cant afford their interest rates. was doing this as a way to bully them into reducing them

    They will not make a Judgement on a CCA but only try to ensure the correct procedures are followed .

    Thats what I thought - but at least it will kick marbles up the bum and show them that I am serious. (or am I just hoping?)

    and dont forget its your legal right to have a copy of the executed agreement, im in the middle of sending fos my compliants for illegible copies of what is supposed to be my cca, but the rules when the cca act was formated are clear, the agreement should also be legible, and mine arnt, never mind fos may say they cannot comment, well im hoping the account is still in dispute due to the copies ive been sent, are not legible, how can my legal advisors advise me????

    You are quite correct to complain, to the FO, about the shamefull attempt by Marbles to ignore their legal responsibilty, under the terms of the Consumer Credit Act, to provide you with a true copy of the executed consumer credit agreement.
    You might like to add, on the complaint form, that you sent a cca request, along with the statutory fee, to Marbles, and that they, Marbles, are now in default.
    Even, at this stage, should Marbles come up with a true copy of the cca, then they would need to seek permission from the Courts in order to enforce the agreement, and the complaint, to the FO, will reinforce any defence that you enter.
    And, as already stated, log any further phone calls, from Marbles, as this could constitute illeal harrassment.
    I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
    If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

    Did have one this morning - from their collectios dept.

    Advised i couldnt pay, didnt have money and wasnt prepared to until I had CCA - wanted to know how i was affording to live.

    Simply told him that i couldnt afford their interest rate and the sole reason for requesting my agreement was to see if they could increase it to such a high level.

    Thats when he gave in and said he would email his "managers"
