Possible redundancy!!

Hi,

Im posting on behalf of my OH who has just been talk to by the manager about possible redundancy at the end of the month. (Just to make things more complicated its my familys business so it was my uncle that has spoke to OH)!!

OH has work at the company since 09/05/2007 and is obviously quite upset as its just before christmas and he has a £400 min per month going on on debts each month so losing his job really isnt good.

My question is: what would he be entitled to? and is there any come back on the company, i.e the famous line of 'ill sue them for everything they got' , obviously that is an over the top saying but you catch my drift? I obviously dont want OH to be able to sue or anything like that as its my dad and uncles business.

    The minimum he will get if he is made redundant is two weeks pay for every complete year of service, so thats a months pay he should get.

    You can't sue someone for making you redundant.

  • thank you bozo. I have just been checking up on benefits and i was hoping you could confirm the following:

    OH claiming

    JSA: £60.50
    Tax Credits: £25.48

    Total: £85.98 p/week


    However if we still go ahead with having a baby (which was the plan starting next year)

    JSA: £60.50 (OH)
    Maternity Pay: £117.18 (Me)
    Child benefit: £18.80 (Once born)
    Working Tax: £61.65
    Child Tax Credit: £10.50

    Total: £286.63 + would be entitled to a sure start maternity grant of £500

    We would be living with his parents so only low rent going out £175 p/month


    If however, OH claimed his benefits and I carried on working and we waited to have a baby our weekly income would be £265.78. So we would be £2.85 worse off a week, plus the petrol it will take to get to work plus, wouldnt get the maternity grant unless we claim as a couple as he is the once claiming the JSA.

    Sorry if thats confused you - it def has me! So i guess what I am asking is do we treat this as a opportunity to have the child that we have wanted, whilst the extra help is available?

    I can't help on the benefits situation as I am not up on them.

    Look at https://www.entitledto.co.uk/ as that what the people in the know reccommend.

    thank you bozo. i understand, i know what your comments will be, and i feel the same about people claiming benefits when they dont really need to. Its just a question that I needed to ask.. thanks again

  • After speaking to the boss (dad) he has said there is the possibility that he could stay part time, so now Im thinking if he worked a 16 hour week, would there be any benefits he would be entitled to?

    You legally don't have to get anything until you've been there two years... I'm in a very similar situation at the moment and my employers / the union have negotiated a deal of 8 weeks pay for me, even though I've only been there 18 months. So, just because he legally doesn't have to get severence, doesn't mean he won't (particularly if there's a family tie!).

    Again, no idea on benefits, best bet is to keep going through the website with different circumstances :)

    If your hours are shorter and you are being paid less, there maybe a chance that you are entitled to working tax credit, if you are below a certain level of wages, It is certainly worth while looking into. If you already have working tax credit, then you have to advise them of any changes to your personal circumstances. Hopefully things will pick up for you.

    thanks for that. No we currently have no benefits. I have no idea what to do :( the idea of working 15 hours p/week has just gone out the window
