SCOTTISH DISCLOSURES back ground checks

I
have been offered a job at home, it requires a background check and a scottish disclosure. I do not have a criminal record but 20 years ago I did something stupid and got a record for it, and 6 years ago I was accused of shop lifting even though I paid for what they said I stole, I recieved a caution but as I didnt steal anything the store didnt seek recompense. I have been adivsed that as one was 20 years ago and I am 40 it will not count and the other was a caution 5 years ago so therefore I do not have a criminal record anymore.

THey are not seeking an enhanced disclosure but a scottish one, can anyone tell me if they have any experiences of these please?

    Don't know about the "scottish" element of this, but my understanding of the English version is that both the 20 years ago incident and the 5 years ago will show up.

  • Both incidents will be on your report-however, it it is a basic disclosure, it will not detail in depth the offences, just the charge and the outcome, see the part of my post at the bottom for more clarity on this.

    If it is an enhanced disclosure or indeed a standard then it may show the Police National Computers comments on the case and enhanced details on the offence, but that would be all.

    In relation to thr 'scottish disclosure'-the company is called ''Disclosure Scotland'' and it does search the Police National Computer and Court records for the whole of the UK. Therefore any offences will show, including those offences shown on the Scottish Police Records.

    See this link below-it explains the service. I myself recently had a search done as part of my job because I come into contact with vulnerable people. I am just about to have another done, and every time I fill one out, even though I have done numerous forms, I always get confused filling them in. I do not have a criminal record however so at least I know my reports are clean. However if I was in your circumstances, I can understand this is causing you some anxiety.

    PS-bearing in mind if you are applying for a basic disclosure only, then only unspent convictions will show. So you need to check if the two offences you have committed are spent or unspent. I would of thought that the 20yr old one is well and truely spent, but as for the shoplifting incident, I am unsure about this. It depends on what punishment you recieved and when you did it, which depends on how long it is before you are classed as rehabilitated. If you want to PM me with what punishment you were served with then I can always find out for you, if it is spent or unspent.

    The reason most companies use Disclosure Scotland is because a)they tend to be slightly quicker and b) They offer the basic discosure wheras the UK CRB only offer standard and enhanced.

  • well that is clear now it states a basic check and as the last one was a caution and I am allowed to say no to any convictions about a caution and after 5 years it is gone!
  • Just make sure yuor conviction is spent otherwise it will look like you've been dishonest.
