can I choose my start date

Hi everyone

I have been awaiting my cbr check to come through before starting doing the same job but instead of casual of a part time basis with set hours.

Before I can start part time I need to be able to take two weeks of unpaid leave but obviously with the run up to christmas this is fairly difficult to do, plus if I start before christmas my boss is saying I will have to work christmas or newyear on top of my usual work days which I cannot do.

I havent told my boss I have recieved my check back as they get a copy as well and not saying anything buys me time! But can I turn around and say I cannot start until the week after christmas thus giving me time to work before hand as a casual worker and being able to get paid (as the next two weeks are the weeks for the before christmas pay) or take my two weeks leave now and have no money for christmas.

Any help will be much appreciated

    To maintain good working relationships, you should negotiate and give the employer god notice of what your plans are. Trying to conceal the crb check result is not going to work. It might buy you time and a very irritated boss. Why do you need to take leave? This is the thing you need to be open about and negotiate on.

    I need to take leave as I technically have to finish working on a casual contract and give head office time to get me out of their system and then back in again. If it wasnt for having to take these two weeks off I would start the job tomorrow but cannot afford to not be paid before christmas.

    I think you need to clarify this further. It should be possible for the company to amend your records within minutes, hours at most. I don't understand why it would take two weeks?

    So an acceptable resolution for your boss would be for you to continue as a casual until Jan, then take a fortnight out? This meets your objective of not having a fortnight off, losing pay before Christmas and his objective of having you work over Christmas?

    That is then what you should be trying to negotiate.

    Who is this 'Employer God' of whom I speak? I don't think going to work is a particularly religious experience. Sorry for the typo

    They can't make you, but if you don't, then they might decide not to take you on after all. But don't be naive about this, if your manager is going to find out about your CRB and you don't attempt to come to an agreement, you are going to end up with a worse outcome than if you negotiaite.
