work retention

i dont no if i have posted this in the rite section. any way my husband is self employed and subcontractor, and the company he does work for and has done for a number of years stops 5% retention on every invoice we send them. i have wrote to ask for this money back as it amounts to a fair bit, ( needed to pay of debts) any way we got a reply saying the buildings havent been released, but what we cant under stand is that most of these propertys comercial buildings are now occupied with companys in them.
so before i go writng i would like some advice if any one has any on are rites to this money :j

    If you husband is self-employed, does he have standard terms and conditions of businesses? If not, he will be working under the T&C of the company which is his client. You will need to see what their T&C are to see what they say about a retention.

    Given that the a number of the properties are occupied, they should have gone through all the snagging by now and so your husband should be aware if there were any problems with his work. It therefore unfair that there is a retention against his work - but do look at the contractor's T&C in relation to the contract they have with him.
  • my husband doesnt have any terms and conditions with this company, so we again will have to asked the company for theres, also its not just my husband that works on these building there are lots of workers some on the books and some self employed. so i dont think its fair that if someone else does a bad job and the property needs repair then others end up losing out.
    ie my husband is off to repair jobs this week on buildings he hadnt done any work on. thanks for imfo :T
