soa claim for o/h car

hi all
i have a meeting with the OR and need to know if i can claim for the wifes car (she hasnt gone BR)
The car is leased in her name and all payments have been made from her account........The wife only earns £600 pm the payments are £500pm......
I use this car from time to time so can i claim anything for it on my SOA....
She also has a bank loan in her name which we used to pay the Inland revenue (my debt)............
All very complicated....

Hi skintooooo, do you need to use the wife's car for work or anything else like that? If so, you may be able to put something down. What did you put in your SOA for wife's contribution? It looks like if she has that amount of debt she won't be able to contribute much to the household. Are you trying to avoid her going BR? I know in my circumstances we are trying to keep my husband from having to go BR as it is much easier if one of you aren't BR.
How much was the loan for Inland revenue?

I have a failed IVA after 40 months HMRC decided to br me (im ok with it) had enough of it.........
No loans Cars credit card debts no house but i take home £2k PM if i cant claim for the wifes car & loan (my debt)then i will have approx £500pm spare,
which i believe will ve an IPA for another 3 years am i correct ???0 -
If you use yor wifes car regularly you could claim for petrol and maintenance, but as you have a company car you won't be able to.
You also won't be able to claim anything towards to loan that is in her name, even though it was taken out for your debt.
You're correct in thinking that you'll have an IPA for 3 years on a percentage of your surplus. If you post your I&E we can have a look and make sure you're maximising all your allowances, these will be higher than you were allowed for your IVA.Accept your past without regret, handle your present with confidence and face your future without fear0 -
the payments ,maintenance, fuel costs,and the bank loan will more than exceed her monthly income is it possible the OR would allow me to claim some of these costs!!! Otherwise they would be putting us in a situation where by i am getting further into debt...........
The car is leased and would cost to much money to give back to the leasing company(havent got a large lump sum to pay it off).
My vehicle is classed as a van (if this makes any difference)so can i claim i need it for weekends, holidays etc....
Sorry to ask lots of questions but the answers could make the difference between paying £500PM or paying nothing and not getting us into further debt !!

Hi Skintoooo, I realise from calculating your wife's income and the cost of the car that she can't afford it on her salary alone, I asked what ( if anything) you put on your SOA as your wife's contribution. You'll need to scrap any contribution and put her whole salary into her debts. I don't think the OR will allow you to pay for the car unless you need it. What reason woul you say you need it for weekends? It can't be for recreation as that is not a need.

Putting any payments towards your wife's debts on your SOA will be disllowed (if she has insufficient income to cover herself) effectively you would be favouring her creditors over yours. You might be able to tweak your SOA to cover some of this though0
