hi there, my friend is having a hard time at the moment, she has just had her house repossessed through not keeping up with payments on a secured loan, she moved out last weekend. she still has lots of unsecured debt...which she has payment plans with most of them where she pays very little each month and the interest is frozen. I do not know the exact figure of the debts in total but it is quite a bit...thousands. the best option for her seems to be going bankrupt.
Now, this is what i think she is going to do anyway, but has not done it yet beacuse wanted to get out of the house etc first then concentrate on the rest.....only thing is she has a summons for non payment of council tax and is due in court this wednesday...what i wanted to know is what is the best thing for her to do about this court appearance????? she is pretty much saving what she can to go bankrupt so doesnt want to be in a position to have to pay that money to the council... should she contact the court/council and let them know that she has just lost her house last week and is due to go bankrupt in the near future??? does anyone know what the likely response would be from them????

I think, but I don't know for sure, that her council tax bill HAS to come ahead of saving for bankruptcy - non payment of council tax can result in prison, unlike non payment of other debts, so it really is important.

My understanding from reading the BK board is that if she has already got a liability order then going BK will not remove her liability for the outstanding council tax,
If the coucil have yet to obtain a liability order, then it depends whether she goes Bk before it is issued or afterwards.If you've have not made a mistake, you've made nothing0 -
