Notice period whilst on probation

Any ideas on the following,

I am in a contract that states I am to provide one months notice to leave the company. My current job is causing me a lot of stress and anxiety. I can't bear the thought of working a full months notice with xmas coming up and other mitigating circumstances making things hard for me. I was supposed to get a payrise after probationary sign off-6 months after joining the company-but this has not happened after longer than that so I financially in a difficult position which is adding stress also. I am trying to make positive changes in my life rather than sitting back and complaining. The sooner I start another position in a less pressured environment, the better it will be for my family. I have another job lined up.

I don't have any holidays left to work out my notice. Therefore unless I can negotiate something I am stuck. But then a friend of mine said, if I am on probation, I don't need to work a month?? So I am confused.

Any useful links would be appreciated, please help!! I would appreciate any advice you guys can give and it would be so helpful!!

    Your friend is wrong. If your contract states a months notice, you need to give a months notice regardless of whether you're on probation or not.

    TBH though, you've picked probably the worst time to want to pack in a job and if you think you're in a financially difficult position now, I can guarantee you'll be far worse off if you leave with no job to go to.

    Hang it out until you can find something else. Jobs are getting a bit thin and it's not going to be improving any time soon.
  • Thanks for the feedback. I feared the worst on this one and I think I will prob just have to negotiate this one.

    I have another job-conditional offer so I am just praying for my start date and I do have 3 job interviews next week as plan b, c and d so I am hoping I am well prepared.

    I have to just sit it out by the looks of it!

    Morning :D

    It might be worth checking your contract small print/with your HR department as I know that the people at my work who are in the first six months of employment only need to give a weeks notice. It varies from company to company.

    Good luck with the job hunting and I hope you find something better soon.
  • It might be worth seeing your doctor about being signed off with stress since the reason you want to resign anyway is due to the stress and anxiety it's causing?
    Owing to financial constraints, the light at the end of the tunnel has been switched off until further notice. :(

  • I am kind of a glutten for punishment to be honest. I have seen my GP and he has offered me a sick note for 1 month but I have an impeccable sickness record and have not been of sick for 4 years-not even a day. So going for other jobs, it looks really good. But I may have no option if things get worse.
    I have spoken to my HR and they said to try and negotiate with my line manager (I had already told them my relationship with my line manager was fragile and management to staff communication was practically non-existent) but they can only advise from a handbook I suppose.

    I realyy just have to play it by ear and hope for the best. I am now being managed by a different line manager and there has been some improvement, but marginal and not enough for me to feel like I can stay and build on my career.

    I have been offered another job and I have checks to complete before my formal offer but I do have my conditional offer in writing. But I suppose this means nothing until the ''real'' thing.

    Depends on the nature of the checks - if it's subject to references and you're not sure about what you'll get from this company, you could ask the new co. to approach HR rather than a manager. You may only get a "Scousebird worked for us from X date to Y date" but that is often all that's wanted.

    If there are other checks, like CRB, credit and security, you know whether there are likely to be any problems. If you don't think there will be (no criminal record, creditworthy and no links to any dodgy groups) then I would try to check whether a basic reference will be enough and resign if it is!
