Help with a CCJ

Those kind people at HBC gave me a CCJ last year, gave them a offer of £30 which they accepted.
But one year on they want to know all my out goings again???
And they want to see a better offer again, are they right in doing this?
I thought once an offer was made, and all payments have been on time, that they could not do anything else, they have told me that they would accept a final offer of 75% of the final ammount to settle the account but at present I am unalbe to do this.
What should I do?

As far as I remember, when you get a CCJ the payment scheme is set in stone, and you cannot go lower, but it is also an advantage because you cannot be made to go higher.
Tell them its in the court order to pay X amount a month and to stop hassling you. I really dont think they can force you to pay more, or ask for proof of how much your earning.
I would though for sure seek some proffesional advice, as it was quite a long time ago since I have had a ccj.0 -
Hi Keith
I think they are trying it on - they have to go back to the Court to request a variation on the order once it has been granted - if you WANT to pay more voluntarily, you can do so but you are only compelled to pay the amount of the order, they can't make you pay more without the variation to the court order.
I had one with the Halifax a few years ago and they kept doing this, asking for a revised SOA and offereing a F&F settlement. I sought advice and was told the above. basically I did not reply and heard nothing more about it. Unless the system has changed, that is what I would do. I would just leave it as it is - there is no interest on the repayments and it will not benefit you to pay it off earlier, pay off any others you have before tackling that one.

On a similiar point, if your income has gone down from the time the CCJ was issued, you are also in the postition to ask for a lower payment by going back to the court and applying for a variation orderI am a debt counsellor working in the voluntary sector - we don't charge our clients for the work we do!0 -
Or is this where the OP already received the CCJ and then made an offer of £30 a month to the company so it was not part of a court order?
If it was then I can understand the company asking again to review the OP income after all they are only trying to get back what the OP owes them, because the £30 offer was voluntarily made by the OP and not a court order.Be ALERT - The world needs more LERTS0
