incorrect price but taken my money where do i stand

Hi all

I have recently bought an item off a website which now appears was incorrectly priced on the website. The company have taken my money from the c card already but have now said they will not honour the price and will refund the money on the card.

I just wondered where i stood. If they have made a mistake in price do they have to sell at the lower price (i suspect not). But what about if they have actually taken the money for the goods - does this change things ? and are they now obligate dot sell at the lower price

any advice welcomed

    im not 100% sure on this but if they have already taken your money out your account does that not mean you have bought it at that price therefore should allow you to keep it at that price:confused: dont worry somebody on here will be able to help you properly as im just guessing:D
  • Basically you need to read the site's T&C's which, I have no doubt, cover situations such as this. To their advantage.
    Conjugating the verb 'to be":
    -o I am humble -o You are attention seeking -o She is Nadine Dorries

    I had reason to make a query about this with Trading Standards a while back, and the law states that the seller can make the situation such that neither the seller or buyer are "in detriment"
    In plain English, that means that if they refund your money and they keep the goods, then you're both in the position that you were in before the transaction, so neither of you are any worse off

    yes i agree with amandada ..although it would at first seem that the contract has been completed as they have taken the money the fact that they have now got in contact with you before you recieve the goods would probably mean that the they can legaly just give you a refund....still kick up a fuss and you never know!! :)
