I paid much more than I would have liked for a pair of shoes today in River Island (£54.99). Was desperate to find a pair for a posh night out tomorrow and couldn't get anything else. However, at that price, I checked with them that they were not ex-display (if they had been I would have asked for a discount) and that girl assured me that they were a new pair from the storeroom and put the display shoe back on the shelf. When I took them out of the box at home I discovered that one of them has a dirty sole while the other is in pristine condition. They're not faulty in any way but I'm annoyed about this all the same. Can I take them back and get a refund? As you may have guessed, I've found a cheaper pair elsewhere

If the sole is marked you should be able to get your money back. If you go at a busy period, they're less likely to argue the toss if that's what you're worried about. You might have to accept a credit note if they're not faulty though.Sealed Pot Challenge number 298, up yours HSBC!0

You can ask, but I wouldn't expect to get much help. If I buy shoes in a shop then I fully expect the right shoe to have perhaps been in the display rack at some point. It's how shoes are sold. If you were genuinely concerned about getting a non-display pair then you should have checked them yourself in the shop.
