hi all
any info greatly appreciated on the following;
I have decided br to be my only option in dealing with my debts.
I just wondered if me going bankrupt could get us evicted from our rented home even tho my partner is the one paying for everything and it is knnown by the landlord im a stay at home mum having just had a baby?
both our names are on the tenancy but he new i wasnt working when we signed it.
i have zero income being a housewife but my debts were from before i got with my partner.But we live together as if we are married ( we are not )Will he be expected to pay them back?can they take his property as assets?
I have no property worth anything but he does.
How do i find out who i actually owe debts to as i have to admit iv hidden from them for a while now and they've been passed on and on and now i have no idea who i owe or how much i believe all in all its roughly 11,000.
Will it go against me greatly that i havent paid them for ages or been in contact.Iv moved 4 times in last 6 years and have a history of mental health problems which havent helped and was unable to work because of it for a while i stil am not upto working but my benefit was withdrawn leaving me with no money which makes me more depressed.im appealing against that but it could be ages before its sorted.

are all the debts solely yours?
if so then BR being personal, your OH is not required to pay your bad debts0 -
Hi Choccycat,
I doubt very much you would be evicted from your home. Some tenancy agreements have bankruptcy clauses in, but that usually to protect the landlord so he evict someone troublesome who has gone BR owing him money.
If it's only you going BR they will not look at your OH's assets at all. All you will have to put on your forms is the amount he pays towards the household expenditure, you don't even put how much he earns.

just to add to the excellent advice above - when you see CAB ask for a debt counsellor, not just a normal counsellor. You'll normally have to make an appointment, as they're busy at the mo, but CAB's normal advisors are not debt experts and it's vital you speak to someone who knows what they're talking about. Hi, having worked in collections a while ago, it may be that some of your debts have been written off because they cannot trace you.
If you have moved four times in six years, it might be difficult for any creditor to find you.
We used to employ an agent to trace a client who moved without leaving an address - we would only employ a maximum of two agents and if both returned to us saying they could find no trace and we could not find any information ourselves, then the debt would sometimes be written off. This would happen more often with smaller debts so if your total debt owed was only about £11,000, it may be that some has been written off.
Have you been on the electoral roll at your address now and your previous addresses? Because creditors check this to see if they can find you too.
Could you check your credit file to see what is on it? On there it will tell you how much the debt is for and the name of the companies plus the name of any debt collectors who have been trying to find you for repayment. It also gives the addresses of the creditors who you have debts with.
Hope you can find some information this way.

now you mention it when i last checked my credit file there was a couple of store cards that were marked settled when i havent paid them.
i wasnt on the electoral roll but i am now.
Can i be traced by getting a copy of my credit file?
I still havent plucked up the courage to contact any helplines.
Im worried this will affect my partner.
Also if i havent paid anything towards my debts for years what the OR think of that?:A

Hi, I think when you do apply for your credit file, it does ask for your up to date address and then will link this to your old addresses on the credit file, so it would give any creditors a forwarding address. I hadn't thought about that originally.
I know you are wanting to get things sorted but as it will update the address, it will probably mean you would start getting letters through to the new address. And it depends whether you are happy to start getting letters through?
They can check linked addresses from the credit file to see if there is a new address for you so they could find out your new address from this.
re the OR, I am not an expert am afraid. All you can do is tell it to the OR how it is, be honest that you were not well enough to cope with them or deal with them properly and just ran away from the situation. If you can get confirmation from any doctor that you were unwell it would help to back up that you just were not able to cope with things.
re your partner & the tenancy agreement. have you checked to see if there is any clause in the agreement about bankruptcy? Your partner could be affected by association if you have applied for any credit together and been credit searched as a couple. But he can put either a notice of correction or disassociation (not sure which or maybe both
) onto his own credit file just to say that the bankruptcy was a personal matter that has not affected his own finances.

just wanted to say thanks for the prompts to contact someone for advice.
i went to the cab today and have got an appointment with the debt specialist on 11th dec.
its the first step to hopefully sorting my debts out and long overdue so im determined to see it thru this time.
with regards to the tenancy agreement thee is a clause that states a bankrupt may not rent the house but as my partner pays everything im sure if we explain it'll be fine.
i'll be back for some help in the near future...:A
