Hi All
Firstly i live on the south coast and work in London doing about 900mls per week

I have searched the forums and can`t quite find the answer i need so i hope someone can help,

I`m PAYE and work all over the London Underground Network (not directly for LUL but for a construction company), i`m never in 1 place for long sometimes just for 1 night,

Most of the time i`m working with other people from the same company where a van will turn up with tools etc so i just have to get to work ( so 1st question is can i claim these miles?)

Sometimes i have to go to work to run the job for 3rd party contractors in which case i carry a work site file (2nd, can i claim these miles?)

My company won`t assist with fuel costs because i don`t have a company van

Any help you can give would be great

I have asked my company what i can claim for and her reply was this

" Your problem will be that you do not travel to and from a permanent place of work and that we do not require you have a vehicle to carry equipment. Should you require copy timesheets there will be a small administration charge depending on the amount of information required."

and also

"
I have advised you as I understand it and that is why I gave you the website address for you to check for yourself as I am no expert in this particular case.

You are basically claiming for travel to and from work on the underground which is a known multicentre workplace. The P87 is usually to make up the difference between what an employer pays you and the 40p etc. As we do not expect you to have a vehicle and do not contribute as business mileage they will probably not consider yours business mileage, sorry.

The cost for admin. will depend on how much information is required. Please advise accordingly."

At the mo its costing me about £100 per week so i could do with some help.

:o Thanks in advance

If you haven't done already you can view Form P87 on HMRC website (you do need Adobe Acrobat reader). For a govt form looks fairly simple to complete, but it is only for claiming tax relief in respect of your own car, m/cycle, cycle plus hotel expenses. I don't know what the norm is in your line of work regarding what expenses an employer would pay, or whether the salary/wage is set at a level to reflect travelling expenses. I suppose in the long term you have to consider if salary/wage is enough to cover £100 pw expenses.
If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

    Not a very helpful employer!
Where does your contract of employment state you are based? You can claim business miles between your normal place of work and any other places you need to visit in the course of your work. It does not matter that your employer does not require you to travel by car.

Your contract isnt very helpful to you either. If your normal place of work is wherever you happen to be required to work, then no tax releif is due for travel to those sites. You might be OK with travel between a site and a third party.

If your employer requires you to go on this course, HMRC will want to know why the employer isnt paying the expenses for it. yes, you need receipts in case HMRC raises an enquiry into your claim.

my present employer is one of the worst i`ve had ( penny wise and pound stupid) if you know what i mean

hopefully hmrc will bollock them so they then accept my fuel receipts at least for the courses i have to do

Sadly, HMRC cannot tell employers how to run their business - as long as they stick to the tax rules, there is nothing they can do.
