charging order - please help

we had a charging order put on our home last month with thanks to link.......... the judge said if they went for an order of sale then he put into the conditions of the charging order it had to go before him as he would no way let it happen that we have to sell our family home - so long as we kept up the payments from the ccj - which we have done.

Link phoned up last week wanting to know if we could pay the balance of just over £3,000 which we said no. than they wanted to do a financial statement over the phone - again we said no and to put everything in writing. They said they could only do a financial statement over the phone and not by letter. we have now received a letter from them saying if we do not phone them with proposals for payment or to pay in full then they will enforce the judgement order and final order obtained and registered against our property.

can anyone please please help with any advice. I thought they would actually leave us alone now it had been to court and am feeling a little harrassed by them again......

    And speak to the OFT about making a formal complaint.

    if you have a CCJ, then the amount is binding on you and the creditor and they are trying to overturn a court decision. It may be that the reson they do not want to write to you is that they do not want a wreitten record of this.

    If they ring again, tell them you are recording the call.

    Hey, RAS, just curious - the OP said they havd received a letter demanding the OP phone with proposals for payments or payment in full; would this already count against Link as a written record of attempting to circumvent the court judgement?

  • As well as getting in touch with Nat Debtline you may want to get in touch again with the court and see if they can put a copy of this letter on the case file. Then if Link try anything else there will be a record of their attempt to circumvent the court, which it looks to me is exactly what they're trying.

    my hubby has just had another phone call from these but he is at work. they asked for a number but i said no... i sent a copy of the letter to citizens advice last friday but don't know if they willcontact me as our case with them was closed 2 weeks ago, as all creditors have now accepted payments. Only LINK are being gits.

    do you think its worth us reporting them for harrassment and what would happen to them if we did do this?
