Do not worry about threats of court action its all bluff. It would cost them too much ,and JUDGES do not take kindly to court action when someone is making payments to a debt already.0

Im sorry to bump my old thread guys.
All was going well, i was making my payments then a week ado i received 2 letters in the same day from MCS. The first one was dated the 2nd of March asking for an increase in im repayment and the other dated the 10th of March saying they are going to apply for an 'automatic increase to my payment plan'
I replied to them on the day I received both letters saying what had happened and that i could not afford to increase my repayments.
Today I received a letter from 'DG Solicitors' dated the 25th or March saying;Our Client is now aware that you have failed to comply with our arrangement and we have therefore been instructed to proceed with legal action, applying the costs and fees incurred directly to your account.
To prevent this you must pay the full balance within 10 days

I would do a CCA request . Costs a £1.00 send recorded delivery . If they can not supply a copy or have lost it , debt becomes unenforceable .0

Did they ever actualy inform you of an increase in the amount you had to pay? If not then you have been sticking to the plan. Unfortunalty all you can do is write to them and point it out that you made the payments you were told to make. Although if they take it to court you will get a ccj that will then be set at the amount you can afford.
No, all they said was for me to write to them with an offer of an increased payment. However i got that letter on the same day as them telling me that iv not replied so they will apply for it themselves.Hi, we’ve had to remove your signature. I sent them a letter today basically saying I have been keeping up with the agreed Monthly Payments so i dont see how i can have failed to comply with the arangement.
