Unpaid bonus

Hi Everyone
Just wondered if anyone can help please??
My Husbands bonus scheme is paid a month in arrears, last months bonus which he qualified for is due to be paid next week. This morning he has been told that as the companies revenue is not as good as should be they have decide not to pay anyone bonuses this month. He has been given no further details on how much revenue was down etc. Can a company pull a bonus that has already been worked for without warning??

You need to check his contract. I doubt anyone will be able to help without seeing it.0

I did check the contract but there is no mention of the bonus as the contract is 3 yrs old but the bonus was only bought in 18 monthes ago. I guess with nothing in the contract they can do as they wish??0

Without a written clause to rely on terms can be implied from a course of dealings ie. they've always paid the bonus in a certain way based on performance etc on a certain date.
I wouldn't hold out an enormous amount of hope though as they will undoubtedly argue that any bonus payments were at their absolute discretion.0 -
If it's any consolation my Christmas bonus has been cancelled this year.0

My OH friend has spoken to his union regarding the company bonus scheme not being paid on time and the union said as it is a company scheme they have no control over it, it is sooooo wrong they did this last year at OH work the week before christmas and people where counting on it for christmas

Ours has been cancelled too but it was exactly that - a bonus and not to be relied on as income.
Sucks but at least we still have jobs. Oh, no pay rises either, inflationary or otherwise. Sucks x2.0
