Hbos and the data protection act

Hi everyone
this is the first time I have posted on this forum and I was just looking for advice I posted on the reclaiming bank charges forum and was pointed in this direction. I started getting calls from hbos in August saying I had missed payments on my loan. I argued and said I wanted it in writing I also sent a letter of complaint this went on until the 7th November and I got a call from Albion debt collectors. They eventually told me to call customer complaints and it transpired that they had not updated my change of address correctly. I say correctly cos my online banking showed the correct address. They had even sent the reply to my complaint to my old address I moved 2 years ago and informed them of this. So all the the letters have been going to god knows who. They agreed they were in the wrong and said they would refund all the charges and all I owe them is £47. I am still waiting for this to be done. Yesterday at 8.30am The calls started again. I got straight back in touch with the complaints dept and they said it was an automatic dialling system and they would make notes so I dont get anymore calls and everything should be resolved in the next 5 working days. At 8.30pm last night in front of all my family and friends the debt agency called asking for money. They said it was a dialling error!! again. At 8.30am today hbos called yet again!! laughed and said oops we already called you didnt we and hung up. I am at my wits end I did think this was getting sorted until yesterday. I have had to take time off work and have got the docs tomorrow not sleeping and so stressed. If anyone can give any advice I would really appreciate it. I'm so angry too. Are they not in total breach of the data protection act?

they are certainly in breach of their own guidlines, I think you can complain to them, and then to the Ombudsman, but I'll bump you so that s'one more knowledgable can advise.0 -
