Hi, I have cca requests to all of my credit card accounts.
Mint has sent me a letter saying
"The above account is not a loan account and therefore we are under no obligation or requirement to provide you with the requested information"
Are they right? What do I do now? They have returned my £1 posal order.
They refer to the CCA section 77(1). Does this only refer to loan accounts?
Help really appreicated.

when did you take the account out? Is it before or after April 2007? If before yes they should supply one but if after it doesn't matter.0 -

I'm as confused as the next person about the new Consumer Credit Act but it seems to me that the old section 77 still stands. I've copied this from the new section 6. Doesn't non-compliance with a s77 request means the debt is unenforceable until the request is complied with?
(6) Where this subsection applies in relation to a failure to give a statement
under this section to the debtor—
(a) the creditor shall not be entitled to enforce the agreement
during the period of non-compliance;
(b) the debtor shall have no liability to pay any sum of interest to
the extent calculated by reference to the period of noncompliance
or to any part of it; and
(c) the debtor shall have no liability to pay any default sum which
(apart from this paragraph)—
(i) would have become payable during the period of noncompliance;
or
(ii) would have become payable after the end of that period
in connection with a breach of the agreement which
occurs during that period (whether or not the breach
continues after the end of that period).0 -

I'm not up on this, but did you ask for the information under s 77 or s 78? It might be (and I'm not sure!) that s 77 is for loans and s 78 is for credit cards.0

If you took out the card that long ago the odds could be very good that they no longer have a copy of the original CCA.
IMHO they know this and are trying to bamboozle you to cloud the issue.
What exactly are you trying to achieve with the CCA requests?
Your letter could have been slightly ambiguous and they've sneaked out that way.
