Urgent please

Hello everyone
Sorry my post is a plea for help But I am desparate now.

In 2005 I received a parking ticket and A FINE for going through a red light bithe within days of each other as my hubby walked out after 26 years and I was devestated to say the least.
Anyway 4 months after I had a letter tell ing me the fine which I thought was the parking fine was 60 so my mum paid via check . 18 months later i got another letter from the council telling me I hadnt paid and i was most sure i did thinking about the other one i paid, anyway they asked for payment i called and ezplined i paid with check and could send off as my mum got copy from the bank not thinkking this was the other one.

sent that all off to the council and never heard a thing so I though all dne and dusted.
On the 24th oct my car was clamped on my drive with a notice for paymetn regarding this parking fine which i had mixed up with the traffic fine and not paid my god what a mess this is..

anyway the bailiff said he wanted 500 t release the car which was not mine but hubbys and all in his name they said it was mine and was registered to me so was taking and if i didnt pay they would require another 175 for the tow truck.
i paid 100 on my debit card and then hubby gave them checks for ther rermainder, which after seeking legal advice we cancelled as we didnt have there first letter with reduced payment offer or a visit which you are entilttled too.

So now they have come back by letter after me calling to make arrangements to pay via installments I only get 80 per week so would offer them so much a month they said no and put hone down on me.

Today i got letter giving me 5 days from the date of the letter to pay or bailiffs will come back now the letter was dated the 14th so infact i have one day only


Now can they do this?????????????? and how can they take a car thats registered and on finance to my huuby



please help

    i don't really know, sorry. But thought i would post so it will stay at top of list so someone who does know will see it! It doesn't sound right to me... good luck anyway

    I always thought bailiffs couldn't bag your stuff unless they had a court order? Certainly not anything that you can prove isn't yours! Trouble is with a car is that the DVLA themselves state that the registered keeper isn't necessarily the owner of the vehicle.
    If it's the triangular type clamp and they've behaved illegally, I can *ahem* 'point you in the direction of someone who knows how to remove them without damage to either vehicle or clamp'.
    Also, the five days to pay thing sounds like baloney - it's usually fourteen working days, I'm sure.

  • its a distress warrant issued by the council and the council are now not helping me at all saying i MUST RELY on these pigs I cant beleive they can do this the car is registered to hubby and on finance in his name the parking fine was in my name

    And i paid that to the bailiffs by paying 101 on my card
  • they wanted 489 on the day i piad 101 now the debt has gone up to 531 in a matter of days
  • If this were me the first thing I would do is MOVE THE CAR!!! But on the bailiff thing I don't have a clue, I'm sorry!
