hi` i`m new to this, but old debt and being harrassed about it????

I have an old debt from 2001 which i got a ccj for. 2 weeks ago i got a letter from BCW(BUCHANAN , CLARK AND WELLS) SAYING i was owe £1500 and had a court order granted against me. I sent them a letter from this website with the £1 so i could get the full print out of the account. They recieved the letter on the 13th nov and have acknowledged they recieved it and advised me that the account was put on hold.

Tonight i recieved a phone call from them wanting money and threatening to have my wages arrested or my possesions taken. Can they do this?.

They now have 12 working days from the 13th nov to give me the account details i have asked for.

Is there a letter i can send asking them to stop phoning me and all correspondence to be in writing only?

I think i`ve done everything correct so far :mad:

WHATS THE NEXT STAGE OF THIS DISPUTE WITH THESE PEOPLE?

    Can we just check that this debt is covered by the CC Act? Credit card, catalogue or loan?

    If so, the first thing to do is note that by telephoning you demanding money when you have already put the account into dispute, they are breaking the OFT Guidelines and possible the law.

    Your first line of defence is to stop answering the security questions and just tell them that you are awaiting the CCA.

  • Yeah, the debt is from lombard bank. I made some payments to start but lost my job and couldn`t afford to pay it.

    So. forgive me for maybe seeming a bit stupid but,

    I`ve sent the cca letter and got a reply, putting the account on hold.

    I`ve found a couple of letters to send about phone harassment which i will send to them tomorrow by recorded delivery.

    Meantime i wait 12 days for the account details, but what is the +2 days? .

    What do i send them after the 12 days have passed.

    What sort of account? bank account, loan or credit card, or???

    Why not just pay it back? You spent the money, you should consider paying it back, even if it is a token amount

    I tried to pay it back after the ccj was issued, i got the details from the court, phoned up the people who persued it and they didn`t know where the debt was. albeit it was a couple years later. Lombard doesn`t know anything about this debt, but i`m getting hassle from bcw. I came here for some advice and saying" why dont you just pay it" isn`t very helpful, when nobody knew who i had to pay.

    I think we may have a troll here - best just to ignore them.

    if it was a loan, then you are covered by the CC Act. You cannot claim it was statute barred with the CCJ on it.

    Will be back with the telephone letter and you would be quite within your rights to complain to the OFT, Trading Standards of the FO about BCW's behaviour. Aggressive behaviour when there is a CCA request outsytanding is against the rules.

    Not a troll at all! Sometimes I think it's easy to misread the tone of a post. You didn't explain about not knowing where the debt was etc.., I was just simply asking why you didn't pay it, if you had spent the money.

    You will get great advice from this site, however, sometimes you will get what is called 'tough love'. It just allows folk to see all from different perspectives.

    I do not acknowledge any debt to your company.
    I am writing to you to inform that I request all communications to me in writing. I do not want any further
    telephone calls made to me.
    To continue to contact me by telephone after I have requested you not to constitutes harassment.
    I require all future communications in writing for future Court use. Do not telephone me again – remove any
    telephone numbers you hold for me from your systems.
    Your telephone calls are in breach of the Office of Fair Trading guidelines. If you continue with them after
    the receipt of this letter, an official complaint, together with a log recording the times and frequency will
    be passed both to that office and to Trading Standards, For your information, all telephone calls are taped.
    This type of debt collection method is contrary to the ‘Administration of Justice Act 1970’. In that it is
    intended to cause alarm and distress to the recipient. Your methods will not be tolerated. A formal complaint
    to the relevant authorities will be made.
    Take further notice that continued telephone calls after receipt of a request not to call may constitute a
    criminal offence under Section 127 of the Communications Act 2003. Continued phone calls to my mother may
    also constitute an offence under the Data Protection Act.
    Communicate in writing and ONLY in writing. Your telephone calls will not be answered.

    HOWEVER, CALLS WILL TRIGGER COMPLAINTS TO THE REGULATORY BODIES.

    I trust I have made myself understood on this matter.

    Was looking for that. You need to add the following demand, under the DPA

    I insist that you remove all telephone numbers on your records and confirm in writing that this hase been done.

    Also remove the reference to mother?
