Am i scewed

long story short, while with partner she gave me some money, quite a bit. everything was fine then sdhe became not a nice person to live with, so left, now she is saying i owe her the money back and is threating to take me to court saying it was a loan, even though it wernt a loan i offered on numberous occasions to give it her back, but when we get back 2gether she doesnt want it, now its a permanant split shes demanding it, and even saying stuff like i gona make sure i have everything u own off u.
so am i up swany with a paddle. what are my options, can she get legal aid to persue this through court, does she have to prove it was a loan, like i signed sumit

any help most appriceated

    Not sure about this......I supposed its her word against yours unless you have anything in writing and legal.

    I am sure someone with a lot more knowledge will be along soon and they might be able to help.

  • First off - is it a large amount? I am presuming so because of the agro? DO you feel like you owe it to her at all?
    It is pretty easy to make threats and unless it is a large amount it will cost her a lot of time and money to go through court to get it and even longer if you contest it.
    It might help if you explain what the money went on - if you can prove for example that you were paying living costs and it went to pay off debts you both racked up.
    But anyway I certainly don't think you are in deep trouble just yet but we need a little more info.

  • money went on a car which i sold, cause i thought i wasnt allowed to drive anymore due to ill health, she took a loan out with her bank if i remember correctly, the sum was around £4k. i dont feel as i owe her, i spent money while living with her, mite not total 4k but bought stuff, shopping etc,m bought her tumble drier when hers went bang, even gave her money, so no i dont think i really owe her anything, was lucky to get outta there alive, one time had to have police escort as she was violent

    If she took the loan out, then the loan is in her name and it's her responsibility to pay it. If you didn't sign a contract with her, then there's not alot she can do.

    It's a moral dilema. Personally, I'd pay back what I owe i.e. £4k minus cost of tumble dryer, shopping etc....

    If u didnt sign anything she will struggle to proove u owe it but if you can afford it's prob worth paying her the amount minus the dryer - even in installements
  • am not working due to ill health which makes it nearly impossible tbh. not a bad person, so wouldnt dream of saying f**k you u sort it out foryaself, its a case of i cant
