Claiming Back Income Tax - advice

Hi there,

I posted last month about reclaiming income tax.

Short story...

Girlfriend has overpaid income tax (approx £1000), she didn't get a P60 or P45 from exemployer (crappy company) but does have wage slips.

Inland Revenue won't help without P60 or letter from company. The Inland Revenue have written to company with no response, She has written and called and also cannot get them to provide required evidence.

Would anybody be able to advise what to do next?

As far as we knew it was illegal for a company to withold tax information to the HMRC/In Revenue - which begs the question why they aren't !!!!ed off about this company not providing the required information.

    Sadly there are many many c*** employers out there and HMRC cannot chase them all at the same time. Were you the person where HMRC accepted your payslips, but not your g/f's, although she worked for the same company? Did you do as I suggested and send HMRC copies of your claim and suggest they get their fingers out and treat the g/f the same?

    Yeah we did that but got no response from them, they seem to only respond to letters when they feel like it. We've thought about getting a solicitor involved but that's likely to probably cost the £1000 she wants back.

    I've tried to look for an address to somewhere higher in status than our local tax office but couldn't really see anywhere appropriate.

    If you ring the call centre and quote your details to get to your records and if they can't give you a satisfactory answer to your query, I would ask to speak to a supervisor - remember to keep a record of date of call and who you spoke to. I work in an accountants and sometimes it's easy to get fobbed off - the other day it happened, someone awaiting a rebate of £2000 since earlier in the year - just waiting for someone to key an amendment to the tax return so I rang and was told to wait another 6 weeks. I asked for a supervisor and she emailed the relevant department and got a phonecall today to say the amendment was done over the weekend.

    I would ask for an interview at your local tax office. If you get not satisfaction there, ask for their complaints leaflet which will have the regional manager's contact details on it.

  • Just wanted to update.

    Gave them another call and must have spoken to the only nice person at the place and she's promised to take a look into the case and find out why there are no records for the company. Even got a letter two days later to confirm it.
