Consumer Credit Act - help?

Hi everyone,

i recently watched Panorama episode about the above piece of legislation and how this can be utilised to 'wipe out' some debt. They advertised a firm who would contact your creditors on your behalf asking for the original agreement they would then go through that document and if anything was a miss then the debt could be written off as it wasn't a lawful agreement. They said that in some cases the creditor no longer had the agreement this would automatically clear the debt as without an agreement it wasn't lawful.

Now my situation is that a few years ago (in 1999) i left a long term abusive relationship my ex ran up a lot of debt between 1998 - 2001 in my name then went awol leaving me to pay the £20,000 debt. I have been repaying on IVA's ever since but I am struggling and if the above is a way i could write off some of this debt then I would like to give it a go... I can't afford to pay the extortionate fees these companies pay so am thinking of taking this on my self, I desperately need some help and support though...

Does anyone have any advice and or suggestions how I would word a letter to obtain the agreements from the creditors? and in the main there are other companies which either now own my debts or care take them for the original large banking institutions so would I write to the original creditor or the 'new' company? I have considered filing for bankruptsy but i wouldn't be able to pursue my chosen career with a bankruptsy charge... my debt consist of mail order debt/credit card and personal loan along with mobile phone bill. i desperately want to get my credit rating and self respect back to being 'healthy' I am worried that the reports which were aired on Panorama could be perceived as 'getting away without paying my way' but at the moment i really don't know what to try or do...

Any helpful suggestions welcome... I've been to CCS on a few occasions they advised bankruptsy...

    The CCA request route can be a long and difficult journey . If you do manage get all your debts deemed unenforceable would be very lucky . Any debt deemed unenforceable would still show up on any credit checks as the debt is not written off . I would look again at bankruptcy .
  • I can't do bankruptsy i have worked too hard academically and practically to give up on my career. There has to be another way, without my career there is no point in anything
