Trust Deed

I am in the process of setting up a Trust Deed (Scotland) which I hope will become protected in a couple of weeks. Meanwhile the company dealing with my deed has written to all my creditors informing them of the deed in the past couple of weeks. I was told by the company they would start dealing with my creditors directly and I should redirect any contact by my creditors to them. Problem is that the creditors refuse to stop sending me letters and I am receiving an unbelievable amount of phone calls demanding I settle the accounts before the trust deed is activated, one card company (Co op) has told me they are sending a debt collector to my (parents) house in the next 10 days for payment. Anyone know if they can do this? My mum is at her wits end with all the threats.

    Not sure if they should be doing this or not, but if they do send someone round, they have not legal right to enter your home so you can tell them to just go away. You don't need to let them in or even talk to them. They have as much legal right to enter your hoe as the paperboy - none.

    Might be worth giving nationaldebtline a call to see if there is anything you can do about the phone calls or if they should even be contacting you. There is a template letter here somewhere about phonecalls that may be worth looking for.

    i would like you to think about this....

    lets imagine that you were owed £10000.

    you were then told that the person you lent it to couldn't pay, more....
    you were told that you would get 10% of the debt back. £1K.

    you were also told that in due course you would have no recourse to object and you would have to accept this arrangement. also, that you had a definate timescale within which to object.

    would you?

    Kick up a fuss with phone calls and letters before you lost lots of money from a debt you thought you were owed?

  • Oh that's a horrid time. You will get these calls and letters for a while, some will also sell the debts on and other firms may contact you.
    Send all the letters on to the trustee.
    With the calls , breathe deeply remembering not to quiver and in your best firm but polite voice tell them I am in a trust deed my trustee is now dealing with my financial affairs. Some firms will say never heard of it, just tell them its like an IVA. If they are very insistent tell them you will advise your trustee they have been in touch and if they have not been in touch they will be shortly.
    Check with your trustee but I have a recollection that if it is granted you can advise them that all future enquiries must be directed to the trustee.
    MBNA were my biggest nightmare apart from constant calls to my home they began to call my work at the same rate and demanded our admin that I be taken out of my meeting to speak with them. It was always the same girl , my colleague got so hacked off with it he demanded to speak to her supervisor about the calls be at a level which could be considered harrassment:o. They had also threatened to come to my work and home . They didnt go to either.

    You could also stress that the debt is listed amongst those submitted and that the trustee has advised you cannot enter into individual agreements with seperate companies and again direct to your trustee

    I hope it all goes well for you and once granted the calls will start to slow down. I am just short of my three years now and prob wont feel its real until its ended . Huge readjustment for me but it was such a relief not struggling under the burden of unmanageable debts and anxious all the time.
