I've read previous threads by people being given legal action by these and wish to ask you helpful people for advice as I have been contacted by them also.
I ran up £1200 on a Mint credit card. They want this is 6x £200over 6 months. I also have other outgoing's and the £200 per month they request from me leaves me potless each month, not even enough to live on comfortably.
When they first rang and said "CCJ," I just paid the £200, which ment I missed a payment for something else.
I have just rang now after reading some threads in order to try to reduce the payment to something more affordable (ie £100 per month) and they refused. I told them I really did not have the money to be paying £200 per month and its not I didn't want to pay that much, but it's because I can't!
Anyway, they told me I will recieve a letter from their solicitors within the next 7 working days.
Any help with regards to the processes needed on my behalf?
And I won't be given a CCJ if the courts rule I cannot afford to pay them the £200 per month + my other creditors & living expenses?

provide them with a full Budget ( SOA on here ) so that they can see that youare only able to afford £100 per month.
You would need to do this for a Court anyway, so get it done.
tell them that it is your wish to settle the debt and that you are doing all that you can to repay it.
tell them in your letter that you paid them £200 in haste and fear but that it is not the amount that you would be able to pay regularly.
If it goes to Court and this arrangement is accepted tthen you get a CCJ, so best to give them the whole story, in advance so that they can see the full picture.
You can but try. Lets face it, its now £100 X 10 months, not much difference from what they are after....a Judge wouldnt take kindly to that wasting his precious Courts time.

I would advise writing to them making an offer of £100 (if you really can afford this). Don't speak to them on the phone - refuse to answer any security questions so they can only communicate in writing.

If you are serious about repaying the debt, if you have no dispute about it, then you should pay what you ccan reasonably afford. Back this up with real facts and figure and present it to them in a clear manner and with reasons as to why they should accept your offer.
You have to try to either, pay it without going to Court
or, prove that it is unenforceable/ not your debt.

What is the current climate with regards to bank charges?
I am owed approximately £1500+ from this, and the last I read on the matter was financial hardship cases only. This sum would be enough to wipe my debt to Triton/Mint therefore getting me out of financial hardship as I could comfortably pay the other creditors what they request.
It's just Triton who won't play ball.

Cant help there Ade, luckily I worked for a Bank until the mid 80's. Thn I could see which way they were heading, left and moved all my day to day stuff to a 'proper' Building Society

I was the git who was bouncing stuff for £10 and charging £35!
and for that I am truly sorry
My record was £385 for one small building firm in ONE day. Hopefully he has reclaimed all that....he deserves to have it back.

I'll give it a whirl, it will be my best approach I believe, as if re-embursed, Triton will be nothing but a bad memory.
As I am truely serious about sorting this out however, I've been phoning round cancelling luxuries like SkyTV, reducing mobile phone plan etc to help free up some cash.0 -
Well done. Take as much control as you can, its surprising the difference you can make once you start to actually pay attention to your spending.
Hit triton with your figures for NOW though, not your new, improved budget.
