had OR interview AAGGGHHHHH

:eek: OH had OR interview over the phone this morning,(he had it speaker phone)

OMG he wanted to know dates and ...well really the far end of a fart.:p


all of the debt started by buying a car and having neg equity added on to the car loan so we da a car worth 6000 and a loan for 17000 !!!!

any how at the start of this journey the CAB recomend we sell the car for as much as we could so we could offer a lump sum to car loan (ge money ) and barclay card as you cant favour creditors..

so we cancelled DD for these 2 and tried to set up a DMP for these, barclay card agreed to £5 a month ge money wouldnt agree.

in the mean time we sold the car and got 5700 for it we bought a banger for 700 and had 5000 to split between the 2.

the CAB tried for about 4 months to arange a payment either lump sum or £50 a month for ge money but they kept saying no and passed the debt on ..

any ways back to the interview..so we have 5000 in the bank . the banger keeps breaking down so we sell it for scrap £200. and spend £2500 on a decent car..(we are aloud to keep this :T )

by the OR wants to know what we did with remainder 2500 , so said the dog had pyometra and that cost nearly£700 , we had to buy new school uniforms ,shoes pe stuff winter coats and all school stuff ( 3 kids), and the rest just dwindled away on food and just day to day .. but he wants to know exactley what it was spent on .i mean this was july ,augest and september.

he asked what we used the barclay card for and we said we went to london and bought the kids trainers and some clothes. i sent him all the statements so he can check.

    Unfit Conduct In the period 6 December 2007 to the date of the Bankruptcy Order, Mr A accreted further debt of £88,624.03 by way of rash and hazardous speculation on the stock market of which he knew or ought to have known that he had no reasonable prospect of being able to repay, in that:· In November 2007, Mr A had assets of £21,512 in shares and liabilities of £252,295 with an overall deficiency of £230,783.· In November 2007, Mr A had an average monthly household income of £2,100 per month. Mr A had household living expenses amounting to £1,215 per month and minimum creditor repayments of at least £5046.60 per month. Mr A therefore had a shortfall of income over expenditure of at least £4161.60 per month.· Between 6 December 2007 and the date of the Bankruptcy Order, Mr A incurred further debt of at least £87,214 by way of spread betting whilst insolvent which represents 28% of his increase in indebtedness.

    OH also told him we remorgaged in march (we are now in neg equty :rolleyes2 )


    and that OH changed jobs at the end of april because he was on permanent nights which was causing depression and also had high blood presure, and it was causeing us to argue alot, so old boss wouldnt put him back on days so he got another job....loseing over 7000 a year in pay

    on night shift we could pay all our bills and loans and have plenty left over..

    so thats when all the problems started ,


    but he still wanted to know every detail :rolleyes:

  • BRO/BRU = extended banking restrictions beyond BR discharge date
    (if the OR thinks a BR has been a bad lad)


    IPO/IVA = payments out of any surplus income over £100 per month at a rate of 70% (ish)


    each BR case is different, spending patterns, debts, incomes, assets vary wildly

    my telephone interview lasted 29 minutes 15 of which was silence as the OR typed in my replies, but ive no assets, and had a ltd company go bust on me owing me £14,000 and i attempted to trade on when frankly i shoulda cut and run

    Mine was only 24 minutes and he was lovely, but I had been in an IVA taken on in 2005, I was then ill and it failed so any hope of my remembering where all the money had been spent was never gonna happen. Also my ex left me with all the debts only one was joint.

    My car was made exempt only worth about 1100, and needed for work, no nil tax code as he said it was not worth it. I then got some forms to fill in and return, got the exemption letter for the car and heard nothing since.

    I think it depends on each case and also the OR himself/herself.

    Sorry you have had a rough time of it.
