Returing debt to original creditor

Is there a way to make the original creditor (Goldfish) take the debt back from the DCA (1st Credit)? I remember seeing this mentioned before, and wondered how to go about it?

    Hve 1st credit bought the debt (been assigned to them) or are they just collecting on behalf of Goldfish?

    Make a request for the original CCA ( if there is one ). Templates are on MSE or google National debt Line, they have them. Follw instructions.

    If no CCA then debt not enforceable so it doesnt matter who has it.

    Then its IN DISPUTE and its been so for more than 30 days! You need to send the 30 day letter ( anyone help with the template? Stapeley? ) and point this out.
    They cannot enforce collection of the debt at the moment and they cannot send it to someone else ( eg Connaught , same animal as 1st Cr ).

  • I'm sending them the monthly amount I had agreed with goldfish, should I stop doing this? They are now threatening legal action

    Make the payments....if they go to Court
    1) No CCA
    2) you are making payments

    Debtlady 2, 1st Credit 0

    and the Judge will love that:D

    Send the 30 day letter

    It's an older post, but I have it bookmarked just in case my requested CCAs don't arrive (fingers crossed).

  • Thanks for that, but I read somewhere that it's no longer an offence to fail to provide a CCA within the 30 days. Is this correct? I want to make sure I have my facts straight!
