    That's good keep every thing. I think Judges are getting fed up with dealing with SD from these parasites. The fact they are refusing payment arrangements would back fire on them . I would just start sending payments, that you can afford , keep reciepts . In the meantime a request for a notice of assignment will shown if they bought the debt or are acting for someone . Request the CCA at the same time .

    Nope!
    They want full payment and they will exhaust all possibilities first.
    Expect Statutory Demand but they probably wont take it any further without min 50% equity in house as its v expensive for them to do so.
    They suggest you giving them a Voluntary Charging Order onyour home in exchange for setting aside a SD...see above re equity!
    A collapsed proprty market is good news for some of us!!

    Take 'proper' advice ie NDL, CAB etc

    Keep offering payments. Dont ever 'phone them. E-mail is good as their system auto-replies.

  • That's good news - we only have about £20K Equity on a £155K mortgage MAX.

    Will do as suggested - ask for Notice of Assignment, CCA & send a £10 postal Order by Recorded Delivery.

    Save £9!!! its £1 for a CCA request. £10 for a Subject Data request , info held under the DTA Protection Act.

    With reference to the above, I would be grateful if you would send me a copy of this
    credit agreement, statement of account and notice of assignment.

    I understand that under the Consumer Credit Act 1974 (Sections 77−79), I am entitled to receive a copy of the credit agreement on request. I enclose a payment of £10 which represents the fee payable under the Consumer Credit Act of £1 and £9 as way of a payment.


    As you have refused to consider a repayment plan I will continue to pay you approx. £10 per month via Postal Order so that should this case come to court they can see that I am in fact trying to resolve this matter. I have asked for your bank details in the past on several occasions but you have not given these to me.

    I understand a copy of my credit agreement should be supplied within 12 working days.

    I understand that under the Consumer Credit Act creditors are unable to enforce an agreement if they fail to comply with a request for a copy of the agreement under these sections of the Act.

    I look forward to hearing from you.

    In that case send them £1 AND £10.
    Otherwise they could claim that you were £1 short in November....Yes they are that petty and nasty and evil and greedy and vile and parasitic and slimy and and and and:D

    Have you thought about using a fee-free dmp? Was with CCCS a couple of years ago but couldn't live on what I was left with.

    Dont forget your £1 PO with CCA request....NOT CHEQUE! it has a signature.


    I may consider a dmp again though. Saves all the stress.
