Hi guys,
wonder if anyone can give me any advice. I have a liability order against me for council tax. I have come to an arrangement with the council to pay in installments to prevent further action. ie Bailiiffs. when I go BR, will this amount be written off?
Thanks all.

If you have made an arrangement then you continue to pay this for the duration of the BR. When you are discharged the remainder should be written off. But you will probably have to remind the council of this at that time.BSCno.87The only stupid question is an unasked oneLoving life as a Kernow Hippy0

It really depends on your council, we had a libaility order against us, our council dropped it as soon as we were BR, others haven't been so lucky. It's a case of suck it and see, and hope you're council will drop it.Accept your past without regret, handle your present with confidence and face your future without fear0

Peachyprice.....just wondering what you mean by "some people are not so lucky".
We have been made BR is by the local council over council tax debts. They would not even when directed by the judge at the first bankruptcy hearing accept anything less than about £250 a month. So we I think had another bankruptcy thing served and back to court again. This time the judge directed that we pay £25 a month each (£50 total). We then recieved a letter telling us to return again after 3 months of this arrangement. We assumed that this was just a sort of "checkup" that we were doing as instructed. However on that day which was last Thursday the judge said "oh no we can't keep adjourning this" and proceeded to bankrupt us.
This has all been done as the council who have a bit of knowledge of our circumstances refuse to believe that I did not inherit money from my mother on her death.
We have numerous other debts and it is basically the best thing really to happen all round HOWEVER I thought that it would all be over including the council tax issue.....but your post has now made me wonder if the council now have some other trick up their sleeve which they plan to roll out.
Does your post mean that if we are the subject of a liability order (which I am not sure about but the chances are they won't have left that stone unturned as they have tried everything short of imprisioning us) that they can do something else to us even though we are now BR and have our OR meeting on 26/11.0 -
No as the council has made you BR you have no need to worry.BSCno.87The only stupid question is an unasked oneLoving life as a Kernow Hippy0

Thank god for that I was beginning to flap!!!
They have really shot themselves in the foot......if they had let us pay the £50 a month they would have got something.......now they will get zip sero nowt nada.....as we have nothing.......and have run up a debt which started at about £1800 to about 5K....which the members of the shire we live in will have to swallow in increases in C Tax.......they were just so silly...but think really they have done us a good turn.0 -
Yup!!:D and all your other debts are taken care of too
Just out of interest have you spoken to someone like National Debtline about what is involved in BR?
Also have a good read of the first post of the Bankruptcy Help sticky.

Yes spoke to National Debtline throughout this year whilst the council had been playing this issue BR papers on us. I think really they were telling us all the time that BR was the best way as we had no assets. Indeed when a woman from the council came in March to serve the first set of papers even she said "I shouldn't really say this but as this will go into the next C Tax year that will be written off as well."
National Debtline told me to ring business Debtline as well as we are self employed and they have sent us some bumf but I have yet to wade through that...that task awaits this week.
We are mid 30's but even at our age we were still a bit of the "old school" thinking "oh no oh god" when BR was on the cards....but now we are OK about it....esp having read all the positive posts here.0 -
All the best with it all. We will try and help and support you through it all. There is usually someone who can help with most things.
The best bit of advice I can give any one is read as much as you can about it and gain as much knowledge as you can. Knowledge is king.
