Rule of halves

Hello everyone,
I was wondering anyone is in a position to answer a question in relation to the Rule of Halves, where you can hand a vehicle on finance back to the finance company once you are half way through the agreement?
I purchased a vehicle on finance a couple of years ago on a 5 year finance agreement. I made the purchase for business purposes (taxi driver) but couldn't make a go of things and reverted back to full time employment (PAYE). The car I purchased is costing me £360 per month, which I simply can't afford, and i need to find a resolution to my problems :-|
The car, at present, is not roadworthy. It developed a fault with the turbocharger and I had to put it off the road, so I don't even have use of the vehicle for my 360 per month.
Now, my big question is, under Scottish Law, can I hand it back under the 'rule of halves' and if so what will happen about the defects on the vehicle. Bearing in mind that it is not taxed or MOT'd now as it has been off the road for over a year.
Any advice will be greatly appreciated.
