Court Action

Options
Can any one give me any advice please. I am due to go BR on Dec 2nd, but in the meantime I have had a claim form from Severn Trent water taking me to court. Do I defend to buy me time? ( acknowledgment of service ) Phone them up to tell them I am about to go BR? ( do not think it will alter the court action ) or ignore it, knowing that judgement will go against me. They state I have to respond within 14 days.
Any advice would be grateful

    Hi,

    As you have a date that you're going BR I'd give them a ring and tell them that.

    Any CCJ they decide to put on your is basically then no longer enforcable once you've gone BR - so it may not be worth their while to do it.

    I had one before I went BR, which I only paid for about 5 months, but since going BR it's no longer dealt with as that debt is included within the BR.

    Just phoned em, not sure they fully understood what I was saying tho. They said they would get back to me if they needed too, but somehow I doubt it.

    As you're giving up your house so are under no threat from a charging order you have nothing to lose by the case going through.

    However, don't ignore it, send the forms back with the income and expenditure filled in showing that you could only afford a minimum payment. if you don't do this they may well get judgement payable forthwith, which means you would have to pay the whole lot in one go, if you don't pay they send bailiffs. I know you have a date for BR, but it's easier not to get bailiffs involved in the first place as they can be a pain to get rid of.
