    can any one tell me what is CCA requests and what is SAR subject access request means?

    how can you be made sell your house for an unsecured debt .

    By obtaining the charging order on the house MBNA have effectively turned an unsecured debt into a secured one - secured on your house. This has happened to me (MBNA also) and I have been told there is nothing illegal about it! When they held the application in the county court I was unable to attend as I was recovering from a broken femur and clinical depression and could not face any more stress and so it went uncontested. What really rankles is that almost 30% of the debt must be charges and interest added after they had been informed of my inability to pay and my state of health. They have now instructed a DCA to force payment. I am trying to find out if it is possible to return to the Court to try to make them remove the charges and refund PPI payments which I believe were mis-sold as I made no secret of the fact that I was self-employed and always questioned whether the insurance would pay out - which it did not.:mad:
    I wonder if anyone has succeeded in doing this?

    There is a whole forum on PPI recalims, which are particularly relevant if it was a single premium PPi, and another on reclaiming charges

    CCA request = asking the lender to supply a signed legible copy of the agreement you sign when you take out the credit card.

    Not sure about the Subject Access request - can anyone help????:confused:

    If you admitted the initial claim, you'll have great difficulty having the CO removed.

    It's looking pretty similar to the issue of challenging bank charges- Ive just asked for CCA's from MBNA who surprise surprise haven't bothered to respond within the statutory time period- I don't believe all the papers say and will be contacting the Ombudsmans service for some guidance on this- however it's worth bearing in mind if you are on here for guidance that this is not a clear cut area of the law, and the lenders are getting wise to what must be a huge number of individuals and companies on behalf of, writing in to potentially challenge agreements.
    now debt free and determined to maintain good spending habits and build savings
