urgent advice needed tonight pretty please

hey guys

hoping that some one can answer this ..I have an outstanding magistate fine owed by my daughter who was 16 when it was given ..after missing just two payments it was sent to marston baliff who contacted me saying that they are in possesion of a distress warrant and claming that it included their charges .. I rung and said that i am on benefits i do not get anything for my daughter as she has left home and I asked for more time they gave me 28 days to make arrangements to pay ...I sent them a cheque for £20 and set up a standing order also sending them a copy of the reciept for the standing order ..they cashed the £20 and two payments have been taken for the standing order ....they have not written to me but today I had a call they said that the fine remainded unpaid and that they had been given 14 days to collect it ....she then said an ENFORCEMENT OFFICER would call within 48HOURS to collect payment or goods..I said I have been paying the fine they said I have been paying THEIR charges ...I called back and agreed to send a cheque for the fine 1st class after borrowing some money ( I [EMAIL="DON@T"]DON'T[/EMAIL] HAVE A DEBIT CARD WAITING FOR A NEW ONE ) They have been continually rude and threating and difficult when I have just tried to pay as best as I can arrange which is weekly for 4 weeks and I am going to complaint about their treatment .:mad: :mad:

MY question is I have sent a cheque for the amount of the court fine (hoping that it gets there before the baliff gets here ) would the distress warrant ( THE LEGAL BIT ) have included their £50 fee (for what I don't know ) I am asking some one here because believe it or not the lady at the court enforcement office couldn't tell me and I need to know before they turn up because if i have paid the legal amount then they have no right of entry

  • Hi - I would have a look at the original paper work which would have detailed the amounts owing. Deduct the payments made and the amount left should give you an idea of if it includes the fee - I'm guessing that it would.

    Get all your receipts together for payments made - bank statements etc in case they do turn up.

    To be honest, as it is your daughter's fine, not yours, if she isn't resident at your address, they can't take anything of yours anyway. If she has left home, they should really be chasing her at her new address rather than you.

    Might be worth PM'ing Herbie21 for some advice.

    I have been told today by a friend that baliff fees shouldn't be on the warrant and I just can't find out if they can enforce the fees the same way as the fine ..and sadly my daughter got the fine but because she is 16 despite the fact she left home ( ran off with her bf) I am responsible crazy but true lol

  • This is awful. The visit fee that this company can charge is £175 !!!


    That is why they are saying that the payment may not arrive in time....as it will give their bailiff a chance to charge this visit fee.

    Can you let me know which part of the country that you are in and I will let you have the details of the Contracts Managers assigned by HMCS to receive complaints. By part of the country I mean North East, South West, London etc.

    Who's name is this debt in? If this is in your daughters name then you are in no way responsible for paying this debt.

    If your daughter did not receive details of this fine then she is entitled to file a Statutory Declaration.
