threat of statuatory demand

I had a CCJ from Yorkshire bank for £1800 they have now sold the debt to Phoenix S.A.R.L and they are using Marlin finacial services to collect the debt.

The CCJ went into arrears Through my own pig headednes and now they have treatend me with a Statuatory demand, I offered them £100 a month to clear the dept but they refused saying its too late and they want 450 a month. I have morgage arrears im paying off and other debts im in arrers with that i am slowly paying off, What i need to know is, is there anything i can do to get marlin to be more resonable and accept a paymet i can afford as £450 will leave me with about - £200 a month. I know that i am in this situation through my own stupidity but i could really do with some advice now.Also can CCJs be included in a DMP?

    hello and welcome we have had stat demand served from phoenix sarl/tessara who use marlin, there is nothing you can do to convince marlin to be reasonable they dont understand the meaning if the word i'm wondering if you had the same conversation as i did with a chap called mark at marlin! they have served this on us despite the fact that we have been in dmp with payplan for two years tthis company sells debt on and buys it back hoping you can't keep up with who has got the debt and so miss a payment giving them the right to serve stat demands ,go for ccj etc request your cca if you haven't already done so we have from them and what do you know they don't have it on file so we are chasing that at the moment will let you know how we get on with them tomorrow in court. if you not on a dmp then you must get one with the sound of your situation we found payplan very helpful and supportive hang in there if you search thru here you will find lots of others in debate with marlin/phoenix etc wouldn't be surprised if they are one and the same good luck and stay with us
  • Am I right in thinking that the OFT guidlines state that demanding unresonably high re payments are classed as harasment and unfair practices. If i offer a reasonable ammount to clear this debt say £150 per month and they refuse and issue a statuatory demand, will I be able to get it set aside on the grounds that they have been unreasonable in refusing to accept my requests to compound the debt?

  • possibly you can write off or phone them and ask you should certainly get some where with the harassement
    we werent as savvy when they were phoning us and they had me in tears on several occasions after threatening to force me to sell my house so go for it but in the meantime get a dmp as son as then if it does go to court you have them to support you
