for creditors to declare you bankrupt they must first issue a Statutory Demand: the formal legla demans for repayment in full within certain period (21 or 28 days i think) If you fail to comply with statutuory demand they will issue a Bankruptcy Petition, the court would set a hearing date and time for the petition to be heard. If debt is not paid in full by time of hearing the court would make a bankruptcy order, even if you do not attend the hearing.
So as long as you are not issued with both a Statutory Demand and a Bankruptcy Petition you will not be made bankrupt by a creditor.0 -
Thanks Kevker, I hope you are right. I will be calling the Insolvency Enquiry line this week.....and then get things moving. It will be good if I can keep one of the accounts available in the UK as I will need to be able to make payments to ex wife etc for Maintenance.....
Time will tell I guess.....
