hfc debt transferred to marlin help please

Hi,
about 2 years ago i entered into a voluntary repayment plan with all my creditors, no payments have been missed, but recently my debt with hfc bank (about £4500) was transfered to marlin, i currently pay them £17 a month, marlin have been totally un co-operative insisting they want £180 a month which i just can't afford. they are currently taking me to court, after reading on this site i asked them for a copy of my credit agreement in august. they never sent this so i defended the case using a letter off this site. I have not had a court date yet, but this morning i have received a copy of the credit agreemenet and feel i don't have a leg to stand on. Am i able to retract my defence? is this the best option? or do i have to go to court?
i would be extremely grateful for any advice

Not my area of expertise, but don't panic just yet! Credit agreements have to have some specific things on them to be valid - for example, can you find your signature on it? And they certainly didn't provide you with the CCA within the timeframe they are supposed to, I think...
Hopefully someone more knowledgeable about this will be along to help soon.

on further examination of the document they have sent me i am not sure if it is the proper credit agreement, it is titled "your priority application for the freeserve card". I don't know the relevance but there is no mention of interest rates or APR, there is no mention at all to do with repayments or penalties for missing payments, it is more about them sharing my information with credit reference agencies, but at the end were i have signed it it does say"this is a credit agreement regulated by the consumer credit act 1974. sign only if you want to be legally bound by its terms"0
