finally decided br my only option.Help needed

hi all ,

have now decided to go br after 2 years of hell fighting off creds thinking things will get better for me well they havent its got worse by the bucket load have just loss job/relationship has ended after 14years and now the br route where i will lose my house.:o

i have a question which i would really be greatful if someone can advise me ive noticed on the br forms it says something like are you currently involved in litigation which i am regarding credit card debt etc could this stop me from declaring myself br :mad:

    No, it won't affect your BR in any way. The kind of litigation they are talking about is if someone is suing you and likely to get a payout. This would need to be accounted for in your BR. Many people (me included) have credit card companies taking them to court, still list this down anyway (I don't think I listed it though because didn't really think of it that way) or wait until someone on here comes up with the correct answer but at least now you know it won't affect your BR.

    many thanks for that advice as this has really screwed my head up the trial date is set and its something i could really do with out things im going to miss once declared br is my house and cats,i am now unemployed do you know if its ok to sell my car before i go bankrupt as im going to need money to live on no benefits allowed for 26 wks as have signed a compromise agreement with employer which will give me p nuts in return my car is worth 2400

    I would have thought if you need to sell your car to live on the proceeds for a while there wouldn't be a problem especially if you prove why you sold it (so they don't think you are disposing of assets!).

    Why do you have to give up your cats?

    I know how you feel though. We are moving out of the country, just waiting to sell our house, and our dogs are being rehomed tomorrow. We are absolutely gutted about losing them but glad that they already have a new home and will only have to spend one night in the kennel. I also thought if we rehome them now they won't be somebody's Christmas present to be taken back afterwards.

  • FYP, I'm so sorry to hear about your dogs. That must be such a hard decision to make. I'm glad they've got a new home to go to, and I hope you find one soon, too.

    Outofcash, you might be able to find somewhere to rent where you can keep your cats. You're allowed money for food and insurance for them in your SOA, and lots of landlords who state that they don't want pets will actually accept a couple of cats if you ask. Ours did! Hope it works out for you. CBx;)

    many thanks for your comments regarding the cats i have agreed for the my other half to keep them so its just myself i need to look after will be filing papers for br in dec due to various things i need to sought out 1st.

    would just like to give everyone an update on my br situation was declared bankrupt today 10am nowhere near as bad as thought didn't have to see judge spent 20 mins going through forms with court clerk who was really nice and helpful and a 10 min phone interview with the official receiver which was nothing its the big interview with the OR i am stressing about as i think i will be geting a bro+an ipa lost 4k gambling total debt 65k really glad this hell is over its just the emotional side of splitting with my other half and losing my home over the next 12 months have great memories and all that a hard lesson learned.Good luck to everyone on this site with whatever course they choose in the future.
