Buchanan Clark Wells and Unpaid rent of housemate.

Hey guys,
This is my first post on these forums but I have been reading stuff here quite a lot. I have a slight issue with BCW as they are claiming that I owe them money. The facts are as follows:

- I was living in a house for 1 year.

- I had an oral agreement with the housemates, which was later confirmed in writing with a witness, about the payment of the utility bills in the house.

- Basically I was supposed to pay £440 in total for the utility bills.

- However, me and the other housemate fell back on payments and the Southern Electric transferred the case to BCW.

- I however, paid my share of £440 by that time.

- Now BCW is asking me to pay the share of my housemate, when I clearly did not agree to pay for him.

- I told them about the situation and they contacted southern electric who state that they do not accept "informal" documents. However, afaik, oral agreements with proof of the agreement in writing are vaild, right?

- Also, to make things worse, I do not have any tenancy documents regarding my stay at the house. And I have no clue where my last hosuemate, who did not pay his part of the bills is located.

    Not my specialist subject, but if your name was on the utility bills, you may be on a bit of a skicky wicket here, as normally the person who signs the agreement is legally liable. However, if someone elses name was on the bills, they should probably have a harder time pursuing you.

    Hopefully someone else with more knowledgeon this front will be along soon. :)

  • Thanks Jes, the annoying thing is, even after I showed them proof of the agreement they still maintain that I am somehow responsible for the remainder of the utility bills.
